The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the Florida Department of Community Affairs. Summary of RequestjReport: LOTS 52 and 53, BLOCK 3 and LOTS 2,3,4,51,52, and 53 of BLOCK 5 have already been changed from SC to IS in the First Round of Map Amendments (Amendment #'s 27-31). Findings of Fact: 1) The designation of the above m~ntioned properties as Improved Subdi- vision (IS) rather than Suburban C,)mmercial (SC) will be consistent with Section 9.5-213, Purpose of the Improved Subdivision District, and the uses permitted within the district (Sec. 9.5-242). 2) The determination was made based on the following: The zoning maps in existence before the land use plan show the lots as RU-1. The SCIIS boundary on the maps signed by Charles Pattison is in error. Lots are currently vacant and in a platted, improved subdivision. 3) Analysis of the existing uses of the property and surrounding proper- ties indicate that the essential neighborhood characteristics support the determination to designate the above lots IS. Also, Lots 50 and 51, Blk 3 and Lots 2, 3, 4, 51, 52, 53, Blk 4 Cutthroat Estates - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - INTRODUCTION: The applicant is requesting a boundary determination for Lot 51, Blk 4, Cutthroat Harbor Estates. The lot is presently located within the suburban commercial (SC) land use district. The appli- cant feels that the lot should be changed to improved subdivision (IS). The planning department has requested that all of the adjacent lots (referenced above) be reviewed. The department has recommended that these lots should likewise be zoned IS. A site inspection of the lots was made on May 22, 1989. SITE DESCRIPTION: Lots 50 and 51, block 3 are characterized by Buttonwood Associa- tion vegetation. Both are predominately Buttonwood with a few, scattered Low hammock species. Saw grass and Borrichia are sparsely present throughout the lots. Caprock is at grade at several locations. A single family residence exists on lot 52, block 3. Lots 2, 3, and 4, block 4 resemble lots 50 and 51, block 3. They are dominated by Buttonwoods, however, Low hammock species are more abundant and diverse. Saw grass, Key grass, and Borrichia are scattered along the west lot lines on Treasure Chest Road. A large black mangrove is also present. Low hammock vegetation becomes increasingly dominant moving west to east across lots 2, 3, and 4, block 4. Lots 51, 52, and 53, block 4, are characterized by dense Low hammock vegetation. Lot 51, owned by the applicant. Mr. Delrio, is fenced (permit posted, *881-1760). The lot was apparently cleared several years ago and only a few native tree species remain. EVALUATION: All of the referenced lots more closely fit the land use district. By changing the zoning to potential adverse impacts from development on lessened. purpose of the IS IS from SC the the lots would be RECOMMENDATION: It is recommended that the referenced lots be designated as IS rather than SC. I concur with the Planning Department's recommen- dation that the lots were incorrectly zoned and are more suited to the purpose and intent of the IS district. cc: Richard Dispenzieri, Planning Technician Donald L.
