Resolution 384-1989 '-' RESOLUTION NO. 384-1989 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE FLORIDA SOLAR ENERGY CENTER TO FUND A SOLAR ENERGY DEMONSTRATION PROJECT AT PIGEON KEY, AND AUTHORIZING THE EXECUTION OF SAME BY THE PROPER COUNTY AUTHORITIES. WHEREAS, The Florida Solar Energy Center has issued a call for proposals for photovoltaic demonstration projects and, WHEREAS, matching grants in the amount of $20,000 will be awarded to outstanding projects and, WHEREAS, Pigeon Key does not have grid power and must rely solely on diesel generators to supply electricity at great expense to Monroe County and, WHEREAS, the installation of solar collectors at Pigeon Key would reduce energy costs, replace fossil fuel consumption with a renewable energy source, and enhance the image of Pigeon Key as an educational and scientific research facility, now, therefore, BE IT RESOLVED, by the Board of County Commissioners of Monroe County, Florida, that the County Administrator is hereby directed to submit an application to the Florida Solar Energy Center for a photovoltaic demonstration project grant and to execute all necessary documents in furtherance thereof, and that matching funds will be available if a grant is awarded. ~^,Hf-WW '.17 9E:Zd O[Nnr 6B. ~~ t,,, ,-J . _. GENERAL CONDITIONS: 1. The grant funds shall be disbursed to the applicant by an advance request (form attached) for the period July 1, 1989 through September 30, 1989. If an advance is not requested, a quarterly report (form attached) shall be submitted for reimbursement. Quarterly reports must also be submitted for actual casts incurred 10-1-88 through 6-30-89. Funds will be reimbursed on a monthly or quarterly basis for each year beginning October 1, 1989. The Department has the right to terminate a grant award and demand refund of grant funds for non-compliance with the terms of the award or the Solid Waste Grants Program Rule 17-716. Such action may also result in the Department declaring the local government ineligible for further participation in the program until the local government complies with the terms of the grant award. " 2. Grant funds which are advanced shall be placed in an interest-bearing account. Interest accrued on advanced funds shall be tracked separately from. any other funds and returned to the Department of Environmental Regulation Solid Waste Management Trust Fund 45 days after the end of the grant period (Section 216.181(14) (b),F.S.). If there are any unexpended and/or obligated advanced grant funds at the end of the grant period (9- 30), these funds may be carried over into the second year and must be tracked and reported separately from the second year grant. These funds shall be available to spend or obligate through December 31, 1989. An expenditure report reflecting the liquidation of all obligations for the period 10-1-89 to 12-31- 89, interest earned during this period, and any unexpended advanced carryover funds must be submitted to the Department of Environmental Regulation Solid Waste Management Trust Fund 45 days after the end of the quarter (12-31). 3. If you are utilizing the reimbursement method only and have unexpended and/or obligated funds at the end of the grant period (9-30), you may carry these funds over into the second year and must track and report them separately from the second year grant. Expenditures shall be limited to allowable items as listed in section 17-716.620 of the Solid Waste Grants Program Rule: (a) Construct or operate, or contract for the construction or operation of, a waste tire processing facility and equipment purchases therefore; (b) Contract for a waste tire processing facility service within or outside the county or state; (c) Remove or contract for the removal of waste tires from the county, region, or state; (d) Perform or contract for the performance of research designed to facilitate waste tire recycling; (e) Establish waste tire collection centers at solid waste disposal facilities or waste tire processing facilities; and (f) Provide incentives for establishing or expanding privately operated waste tire collection centers for the public. 8. Up to fifteen percent of a portion of a county's grant for fiscal year 1988-89 may be used for administrative costs and planning or research studies to assess the feasibility of eligible projects within a county, or to assess the feasibility of establishing a regional waste tire program. After fiscal year 1988-89, up to five percent of a county's grant may be so used. 9. No more than five percent of a county's grant shall be used for administrative costs. 10. Payment requests and expenditure reports for the first year and payment requests for the fOllowing years must be accompanied by supporting invoices and documentation of all costs necessary for preaudit and post audit review. B. SPECIAL CONDITIONS: 1. Allowable costs incurred on or after the budget period start date, October 1, 1988, may be charged to this agreement. Expenditures shall be limited to allowable items as listed in Section 17-716.430 of the Solid Waste Grants Program Rule: (a) Solid waste recycling grants shall be used to provide funding for recycling program capital costs, which include equipment purchases, solid waste scales, facility construction and other such costs approved by the Department. (b) Grant funds may also be used for temporary operating subsidies, provided that the applicant shall demonstrate that such a use is necessary for the success of the recycling program, and shall show how the subsidy will benefit the program. The applicant shall also demonstrate'that the subsidy is temporary by providing reasonable assurances that the program will be able to operate without a subsidy from this grant program by October 1, 1993. (c) Recycling grant funds shall be used for projects to assist local governments in recycling paper, glass, plastic, construction and demolition debris, white goods, and metals and in composting and recycling the organic material component of municipal solid waste. (d) Solid waste education grant funds shall be used to promote recycling, volume reduction, proper disposal of solid wastes, and market development for recyclable materials. Up to 30 percent of grant funds may be used for planning studies to assess the feasibility and success of the reCYCling and education programs. (e) All existing public and private reCYCling infrastructure shall be fully used to the extent possible when planning and implementing the local government recycling program. Funds shall not be used for duplicating existing private and public recycling programs unless the applicant demonstrates that such existing programs cannot be integrated into the planned recycling program. 8. Payment requests and expenditure reports for the first y~ar and payment requests for the following years must be accompanied by supporting invoices and documentation of all costs necessary for preaudit and post audit review. 9. Allowable costs incurred on or after the budget period start date, October 1, 1988, may be charged: to this agreement. Grant # RE89-42 SPECIAL CONDITIONS: " Due to the time constraints of the first year of this grant program, some counties may not have signed inter1oca1 agreements with all of the municipalities in the county. Therefore, the following options are being made available. You must choose one of the following options, by marking an x in the appropriate block, which will become a special condition of this grant agreement~ Failure to choose an option, or to fulfill the obligations of the option you choose, will result in the Department determining your grant amount based upon the application and inter1oca1 agreements as received on or before June 12, 1989. For counties not submitting valid inter1oca1 agreements with all municipalities in that county, the incentive and/or base portion of the grant shall be reduced in proportion to the populations of those municipalities not applying jointly with the county. All grant funds not disbursed to the counties shall revert to the Solid Waste Management Trust Fund, and shall be used for Recycling and Education Grants in fiscal year 1989- 90. [ ] 1. The Department shall determine the revised grant amount based upon the application and inter1oca1 agreements submitted on or before June 12, 1989, even though the county has not signed valid inter1oca1 agreements with all municipalities in the county. The Department shall determine the revised grant amount and begin to process an amended grant agreement as soon as possible after June 30, 1989. The amended grant agreement will be sent to the counties for signature. [ ] 2. The county shall, by August 1, 1989, submit valid inter1oca1 agreements between the county and any municipalities which had not signed valid inter1oca1 agreements on or before June 12, 1989. This condition includes both counties which wish to submit more inter1oca1 agreements than were submitted previously, and counties which did not submit valid inter10cal agreements previously. This condition does not require any county to submit interloca1 agreements with every municipality in the county. The Department shall withhold all grant funds until such time as the county submits all inter10ca1 agreements which it intends to submit and notifies the Department in writing that it desires the Department to determine the grant amount and begin processing the grant funds.
