Attached is a proposed change order for The Tower Group, for the Freeman
Justice Center. (Change Order #5 is for $73,969.57 for Revised Fire-Rated
Walls and the associated Doors, Frames and Hardware.)
According to the ordinance adopted by the Board of County Commissioners,
proposed change orders are to be presented to members of the Board of County
Commissioners prior to approval, assuming they are within the Administrator's
prescribed limits. Change orders not within the Administrator's authority are
placed on the BOCC agenda.
The Administrator intends to approve this change order on Friday, September 2,
2005.

Dear Mr. Gonzalez:
Attached for your review and approval please find The Tower Group Change Order Request
No.8 dated August 18, 2005 in the amount of $57,737.50 for the additional material, labor and
extended overhead cost to lower 12 deck panels to accommodate the 1st floor concrete deck
design deficiencies.
Please be reminded of the chronological sequence of communication regarding this subject as
follows:
1. July 20, 2005 TTG submitted RFl No. 00134. (See attached RFI)
2. July 2 1,2005 TTG brought this problem to your attention again in our Weekly Project
Meeting. (See attached Meeting Minutes item No. 110)
3. August 8, 2005, TIG sent letter No. 01001 to Gonzalez Architects again requesting a
written directive how to proceed. (See attached letter)
4. August 8, 2005, TIG received memorandum from Gonzalez Architects directing TTG
to slightly drop panels in conflict. (See attached memo)
5. August 10, 2005, TIG sent letter No. 01011 to Gonzalez Architects indicating receipt
of Gonzalez Architects memorandum, and notifYing work is on hold pending receipt of
cost from EBG and reserving our rights for a contract time extension. (See attached
letter)
6. August II, 2005, TIG received memorandum from Gonzalez Architects, stating "It is
the responsibility of the contractor to coordinate their subcontracts, as required, to
implant the solution." (See attached memo)
7. August 18, 2005, TTG submitted Request for Change Order No.8, in the amount of
$57,737.50. (See attached Change Order)
In closing, the critical path progress of this project is on hold, pending the receipt of a fu Ily
executed Contract Change Order. Time is of the essence.

106. Final Count on Security Cameras: P.P needs to know about all
additional cameras ASAP. (7/14/05). PP needs final count & locations on
cameras. (7/21/05). MCCM response to GA security revisions was faxed
to Monica D' Ambra on July 27, '05. MCCM has no objection to the
proposed changes other than the comments included on this faxed
response. (7/28/05). No response from GA (8/4/05). (8/11/05). OPEN
107. Monolithic Floor Pours: ITG: Floor pours are continuous monolithic
pours and will start at 3:00 am. ITG needs permission from Key West
Bldg. Dept. to waive noise ordinance and aIJowthis to happen. (7/14/05).
Monolithic pours begin August 19th. 'ITG will contact Joe April (Key
West Bldg. Dept.) to arrange noise ordinance waiver to allow work after
hours, i.e. early AM to late P.M and Sundays. (7/21105). (7/28/05).
(8/4/05). TTG will talk to Joe April today to advise him of TTG intent
to perform an early a.m. pour. (8/11/05). OPEN
109. Pile Cap Survev & Site Survev: MCCM requestS master sheet of pile
cap survey and copy of site survey done last month. Also MCCM requests
confirmation tbat there are 5 Pistorino & Alam visits remaining on the llil
round of credit to MCCM by way of C.O. #1. (7/14/05). (1/21105).
(7/28/05). TTGto verify number ofP&A visits and establish when first
found of inspections expires, second round begins. Surveyor O'Flynn will
be on site today or tomorrow to work on site survey and to investigate a
suspected 4" discrepancy along column line uD" discovered yesterday.
(8/4/05). TTG received 3 copies of site survey (up to 1" floor including
columns & deck). MCCM will receive 1 copy. TTG: 22 P&A visits
have been used so far including today's visit. Two more visits remain
on the rIrst round of inspections. Second round will begin when these
two are finished. (8/11/05). OPEN
110. Conduit Interference in 1st FIr. Slab: J. Clausell (PP) states insufficient
concrete clearance when 1 n conduit crosses other conduit in 4 ~" floor
slab. He suggests using two %" conduits. GA will look into this. PP
states that exterior wall mounted lights shovro at el. 21'-9" are in conflict
with post-tensioned beam cable. PP recommends lowering lights 1'-0",
GA will look at this_ (7/21/05). PP proposes direct burial flex conduit
(MC-EZ-lYK Armor Cable) to minimize clearance problem. GA will
verify with P&A (7/28/05). ITG requests immediate direction from GA
and P&A as to how to proceed. PP needs to install conduit which allows

to flow properly between boxes and deck forms. Without immediate
response, TTG will be delayed on floor pour scheduled August 19, '05.
TTG will produce a model of the problem. rIDS ISSUE IS URGENT.
(8/4/05). J. GiJnzalez met with TTG & MCCM on Monday August 8,
'05 to discuss this item. GA sent memo directing deck fonns to be
dropped. ITG sent letter of response #01001 August 8, '05 stating
intent to prepare cost proposal. GA recommends ~S" clips to drop 10
deck form panels. (Neither SPI nOr EGB are aware of these deck
support devices.) Can GA advise how they can be installed or even
obtained? ptherwise TTG can not utilize this option and will need to
shore forms from below. THIS IS MORE COSTL V TO THE
OWNER. MCCM requests GA to continue discussion with TTG on
this issue by calling J. Gonzalez after the meeting. TTG requests
MCCM to authorize a cost account not to exceed $15,000 for lowering
and shoring deck panels in the event the method suggested by J.
(rl)nzaJcz is not feasible. ITG replaced 20 deck panels identified by
MCCM as not acceptable quality. H ITG receives GA directive today
stating that lTG will be compensated, work will not be deJayed. S.
Coffer will attempt to contact J. Gonzalez by phone after the meeting.

112. Dowels Cut at Post-Tensioned Beam Columns: Six columns (col. 2 ,3,
4,50,5], & 52) at ends of post-tensioned beams are missing 3 dowels (cut
by EGB because the bends were improperly oriented). TTG awaiting
response from P&A on repairs. (7/28/05). EGB is chipping tops of
columns to allow new dowels to be installed. Repairs may be finished in
time for Johnny Clavijo (P&A) to inspect next Tuesday. (8/4/05).
Columns 20 & 30 are also constructed improperly with vertical
dowels not showing correct bends at the lilt to 2aW floor intersection
and will be chipped out and re-built. AU six oftbese columns were
inspected by Pistorino & AIa.m at the time they were built in February
of this year, but no discovery of error occurred until this week (Aug.
10th) when Contractor attempts to tie ground floor columns to In floor
columns. [This is another example of the failure of structural
inspections to reve3J errors in construction or to identify details which
are unclear until after the work is in place and needs to be
demolished.] Johnny Clavijo will inspect today. (8/11/05). OPEN
113. Coordination Drawin~: TTGto submit coordination drawings (sheet
metal shop drawings as base, sprinkler, electrical, SPI & structural
overlays). Must be DWG files, not plOt files, (7/28/05). (8/4/05). lTG

impact to the project critical path and advise you of our findings accordingly.
Should additional time and cost be required for this change in scope, then we
reserve our right to time extensions and associated costs.

Dear Mr. Gonzalez:
The Tower Group (TTG) is in receipt of your memorandum dated August 8,
2005, responding to the first floor concrete slab structural and electrical design
conflicts. Presently our structural subcontractor E.G. Braswell and their pre-
cast joist subcontractor SPl are reviewing the areas of concern and are
developing their cost and time estimate to solve the problem in the field.
As previously stated, all remedial work in the effective areas in conflict are on
hold pending our submittal, the owner's approval and TTG receipt of a fully
executed contract change order.
TTG reserves its rights to claim for delays, time extensions including extended
general condition cost and all other additional costs when the full extent of the
impact of this change order is known.
