A RESOLUTION BY THE MONROE COUNTY BOARD OF
COMMISS lONERS, SITTING AS THE BOARD OF
APPEALS, DENYING THE APPEAL FILED BY ALICE
AND FLOYD MELTON, OF PLANNING COMMISSION
RESOLUTION NO. 23-89 WHICH RESCINDED BUILDING
PERMIT #89-3-2069, FOR CONSTRUCTION OF A
DOCK.

WHEREAS, the Board of County Commissioners has heard argu-
ment from counsel for the appellant, original appellant and
County with regard to the Planning Commission's approval of the
original appellants appeal of a building permit; and
WHEREAS, the record before this Board has been reviewed and
includes 1) the appeal application transmittal letter, 2) the
motion to disqualify Commissioner John Stormont, 3) the applica-
tion for an administrative appeal, 4) the order abating proceed-
ings pending filing and determination of appeal, 5) the Monroe
County building permit (#89-3-2069), 6) the Planning Commission
Resolutions (H23-89 and 1127-91), 7) the Administrative Appeal
Application to the Planning Commission, 8) the transcript, 9) the
Memorandums from George Garrett and Niko Fulcher, 10) the Melton
dock permit from the FDER and 11) the entire appeal record before
the Planning Commission; and
WHEREAS, this Board finds that the transcripts which have
been presented are not verbatim and, therefore, any inaccuracies
or inadequacies must be held against the appellant as per Florida
Statute 286.0105; and
WHEREAS, the appellants have failed to meet their burden of
proof by not showing how the Planning Commission had erred in
their decision; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the Board of Appeals, that the
appeal of the MELTONs of the underlying Planning Commission
decision, is hereby DENIED.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the
