Key West, Florida
A Special Regular- of the Monroe County Board of County Commissioners convened at
9:00 A.M., at the Harvey Government Center. Present and answering to roll call were
Commissioner Murray E. Nelson, Commissioner George R. Neugent, Commissioner David P.
Rice, and Mayor Dixie M. Spehar. Commissioner Charles "Sonny" McCoy was not present.
Also present were Isabel C. DeSantis, Deputy Clerk; Bob Shillinger, Assistant County Attorney;
Thomas Willi, County Administrator; County Staff, members of the press and radio; and the
general public.
All stood for the Invocation and Pledge of Allegiance.
ADDITIONS, CORRECTIONS, DELETIONS
County Administrator, Tom Willi and County Attorney, Richard Collins addressed the
Board. After discussion, motion was made by Commissioner Nelson and seconded by
Commissioner Rice granting approval to add to the agenda - authorization for the County
Administrator to terminate the contract with Jose Gonzalez Architects for the Freeman Justice
Center. Roll call vote was taken with the following results:

Commissioner Rice Yes
Commissioner Nelson Yes
Mayor Spehar Yes
Motion carried.
Director of Facilities Development, Larry Chalmers; Attorney Ira Libanoff; County
Attorney Richard Collins; Assistant County Attorney, Bob Shillinger; and County Administrator,
Tom Willi addressed the Board. County Engineer, Dave Koppel briefed the Board on a
replacement architect for the Freeman Justice Center that will be made at the October 19, 2005
Board meeting. After discussion, motion was made by Commissioner Rice and seconded by
Commissioner Nelson authorizing the County Administrator to terminate the contract with Jose
Gonzalez Architects for the Freeman Justice Center, and that Staff initiate litigation as it becomes
appropriate. Roll call vote was unanimous.
The Board discussed the impact of a September 9th Federal Injunction regarding the
withholding of Flood Insurance for new construction located in Habitat for Endangered Species.

Assistant County Attorney, Bob Shillinger; County Attorney, Richard Collins; Attorney Tamara
Scrudders, and Growth Management Director, Tim McGarry addressed the Board. The following
public speakers addressed the Board: H.T. Pontin, Stuart Kessler, and Tara Thoman-Wood.
After discussion, motion was made by Commissioner Nelson and seconded by Commissioner Rice
to adopt the following Resolution expressing the sense of the Commission that F.E.M.A. and the
U.S. Fish and Wildlife Service, on behalf of the Federal Government, should perfect an appeal of
an Order Imposing Permanent Injunction in Florida Key Deer v. Michael D. Brown, et al.,
90-10037-CIV-Moore, and should also move expeditiously to take the necessary steps to have the
injunction dissolved. Roll call vote was unanimous.

There being no further business, the meeting of the Board of County Commissioners was
adjourned.
