'A RESOLUTION OF THE BOARD OF COUNTY COMl-lIS-
SIONERS OF MONROE COUNTY, FLORIDA, REQUESTING
THE MONROE COUNTY LEGISLATIVE DELEGATION TO
ENDORSE A BILL IN THE NEXT SESSION OF THE
LEGISLATURE THAT WOULD REQUIRE THOSE PARTIES
WHO FILE SUITS' AGAINST ANY OF THE COUNTIES,
COUNTY COMMISSIONS AND/OR COUNTY COMMIS-
SIONERS OF THE STATE OF FLORIDA AND WHO ARE
UNSUCCESSFUL TO PAY THE ATTORNEY'S FEES
EXPENDED BY THE PARTICULAR COUNTY BEING SUED.

WHEREAS, Monroe County, Florida, is a political subdivision
of the State of Florida; and
WHEREAS, Monroe County, Florida, at various times has been
sued in the courts of the State of Florida and in the Courts of
the United States of America; and
tffiEREAS, attorneys fees for said lawsuits have cost the
citizens and taxpayers of Monroe County, Florida, a great amount
of money; and
WHEREAS, Monroe County, Florida, has been successful in
defending most of the lawsuits filed against it; and
WHEREAS, Monroe County, Florida, should be reimbursed for
its legal expenses and costs by the opposing parties when Monroe
County is the successful litigant;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Monroe County, Florida, as follows:
1. The Board of County Commissioners respectfully requests
that the legislative delegation representing Monroe County,
Florida, introduce a bill in the next session of the legislature
that would require those parties who file suits against any of
the counties, county commissions and/or county commissioners of
the State of Florida and who are unsuccessful, would be required
to pay the attorneys fees expended by the particular county being
sued.
2. The Clerk of the Circuit Court of Monroe County,
Florida, is requested to send copies of this resolution to the
appropriate elected legislators who represent Monroe County,
Florida, with the request that they initiate appropriate
legislation to return some or all of the qualifying fees to the
respective county from which they have been collected.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, It a regular meeting of said Board held
on the~ day of tlAi~k 1991.
