RESOLUTION NO. 349 - 2001
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA SUPPORTING ARTICLE V REVISION 7 OF
THE FLORIDA CONSTITUTION, IN ORDER TO CLARIFY COUNTY
RESPONSIBILITY FOR FUNDING COURT OPERATIONS.
WHEREAS, the Florida Constitution requires counties to fund the state court system
after Revision 7 is implemented.
WHEREAS, Counties will continue to provide court facilities; court security; existing
criminal justice information systems; limited communications services; and certain local
programs - at a cost of hundreds of millions of dollars in support of the courts; and
WHEREAS, under Revision 7, there are many revenue and fee sources available to the
state with which to subsidize the courts; and
WHEREAS, under Revision 7, the transfer of many court functions to the state will
create statewide efficiencies, uniformity and accountability; now, therefore
BE IT RESOLVED THAT THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. Supports legislation consistent with Revision 7 and the Statement of
Intent, stating that such legislation must include:
. Clarifying county responsibility for funding court operations, specifically as it relates to
facilities, security, communication services, existing radio systems, and existing multi-
agency information systems.
. Immediate state funding of essential court elements, including but not limited to, juror
compensation, court reporting services, court interpreter/translator services, conflict
counsel, witness fees, and expert witness fees.
Section 2. The Clerk of the Board of County Commissioners is hereby directed to
forward a certified copy of this Resolution to the following:
