Ordinance 014-1991 = BOARD OF COUNTY COMMISSIONERS ; ORDINANCE NO. 014 -1991 ON E` • AN ORDINANCE AMENDING SEC. 13-8, MONROE COUNTY CODE, IN ORDER TO PROHIBIT ANY PERSON FROM REMAINING AT OR IN ANY COUNTY BEACH OR PARK IN THE UNINCORPORATED AREA OF MONROE COUNTY FROM 11 : 00 PM UNTIL 7 : 00 AM, EXCEPTING HARRIS HARRY HARRIS PARK, AND PROVIDING THAT THE COUNTY COMMISSION MAY WAIVE SUCH PROHIBITION ON A PER EVENT BASIS ; AMENDING SEC. 13-9, MONROE COUNTY CODE, IN ORDER TO PROVIDE THE TERMS AND CONDITIONS WHEREBY THE COUNTY COMMISSION MAY WAIVE THE PROHIBITION ON THE CONSUMPTION OF ALCOHOLIC BEVERAGES AT OR IN ANY PARK IN THE UNINCORPORATED AREA OF MONROE COUNTY AND PROVIDING A DEFINITION OF ALCOHOLIC BEVERAGE; PROVIDING PENALTIES FOR VIOLATIONS THEREOF; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE• AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. Section 13-8, Monroe County Code, is hereby amended to read as follows : Sec. 13-8. County parks and beaches in unincorporated areas to be closed during certain hours. All County parks and beaches in the unincorporated areas of Monroe County, except Harry Harris Park, Tavernier, Florida, shall be closed during the hours of 11 : 00 PM to 7 : 00 AM. No person shall enter or remain at any such park or beach during those hours. The prohibition of this section may be waived by the Board of County Commissioners on a per event basis. Section 2. Section 13-9, Monroe County Code, is hereby amended to read as follows: Section 13-9. Consumption of alcoholic beverages on public beaches and parks . a) It shall be prohibited for a person, in on or about any public facility, vehicle or public beach or park in the unincorporated areas of Monroe County to consume alcoholic beverages. The prohibitions of consuming alcoholic beverages on public beaches and parks can be waived by the Board of County Commissioners as provided herein. b) The Board of County Commissioners may waive the provisions of this section upon a resolution of the Board. However, any such waiver may only be granted to a nonprofit organization, shall require the presence of security guards in the number the Board determines necessary to preserve public order, and shall require liability insurance naming Monroe County as an additional named insured in a form and amount satisfactory to the County Administrator. c) For the purposes of this section, alcoholic beverage means any beverage containing more than one percent ethyl alcohol by volume. Section 3. Section 13-9. 1, Monroe County Code, is hereby created to read as follows : Sec. 13-9.1. Penalties. Violations of Secs. 13-8 and 13-9, Monroe County Code, shall be prosecuted in the same manner as f ' misdemeanors are prosecuted. Such violations shall be prosecuted in the name of the state in a court having jurisdiction of misdemeanors by the prosecuting attorney thereof and upon conviction shall be punished by a fine not to exceed $500 or by imprisonment in the county jail not to exceed 60 days or by both such fine and imprisonment. Section 4. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 5. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 6. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 7. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
