Ordinance 023-1991 Contractors ' Examining Board ORDINANCE NO. aW -1991 AN ORDINANCE OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, PROVIDING FOR THE AMENDMENT OF SECTION 6-90(b) , TO AUTHORIZE THE COUNTY ATTORNEY TO INSTITUTE CIVIL ACTIONS SEEKING MONETARY DECLARATORY AND INJUNCTIVE RELIEF AGAINST VIOLATORS OF CEASE AND DESIST ORDERS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1 . The second paragraph of subsection 6-90(b) is hereby amended to read as follows : "In addition to or in lieu of any other remedies provided above, the Board mays arity_ vote of the members present and in order to enforce a cease and desist order ism ue a� recLuestto�Athe Count Atto�raey and the County Attorne may, in his discretion file a proceeding in the name of the County seeking issuance of an in'unction or a writ of mandamus against any person who violates the rovisions of a notice to cease and desist. Pursuant to the request of the Board, the Coin Attorney may_ additionally seek the imposition of a civil penalty through the civil court for any violation of the notice to cease and desist. The civil penalty shall be no less than Five Hundred Dollars ($500.00) and no more than Five Thousand Dollars ($5,000.00) for each offense. The court shall award to the Board all costs as a result of this violation including investigation costs, filing fees, court costs , and reasonable attorney's fees. Section 2. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
