INC. , LOTS 1 THROUGH 659, A RESUBDIVISION OF
TRACT A OF CUDJOE OCEAN SHORES, LYING IN
GOVERNMENTS LOTS 2 & 3, SECTION 34, TOWNSHIP
66 SOUTH, RANGE 28 EAST, CUDJOE KEY, MM23; .
TRANSMITTING THIS AMENDMENT TO THE STATE LAND
PLANNING AGENCY FOR APPROVAL; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, Section 9 . 5-511(c) , Monroe County Code of Ordinanc-
es (Code) , provides that the land development regulations (Cilap-
ter 9 . 5 of the Code) , including the land use district maps, t6y
be amended or changed at any time; and
WHEREAS, during such process, the Monroe County Planning
Commission, sitting as the local planning agency, after due no-
tice and public participation in the hearing process, has re-
viewed the proposed land use district map change and found such
change consistent with the Monroe County Comprehensive plan and
made a recommendation concerning such change to the Monroe County
Board of Commissioners; and

WHEREAS, during such process, the Monroe County Board of
Commissioners, after due notice and public participation in the
hearing process, reviewed such recommendation and legislatively
acted thereon; and
WHEREAS, F. S. 380.0552 (9) requires that the state land plan-
ping agency must approve all proposed land use district map chang-
es before such changes may become effective; and
WHEREAS, the land use district map change process is not
complete; and
WHEREAS, it is desired that the Monroe County Board of Com-
missioners should approve, adopt and transmit this land use dis-
trict map change to the state land planning agency for approval;
NOW THEREFORE,
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUN-
TY, FLORIDA:
Section 1 . The Monroe County Board of Commissioners on
this 18 th day of September , 1991, does hereby adopt this land
use district map amendment, pursuant to general law, and at-
tached and incorporated by reference to this ordinance, and here-

by transmits to the state land planning for approval or disapprov-
al pursuant to F. S.380.0552 (9) .
Section 2 . If any section, subsection, sentence, clause,
item, change, or provision of this ordinance is held invalid, the
remainder of this ordinance shall not be affected by such invalid-
ity.
Section 3 . This ordinance shall be filed in the Office of
the Secretary of State of the State of Florida, but shall not be
deemed effective until approved by the state land planning agency.

COMMISSION RECOMMENDING TO THE MONROE COUNTY
BOARD OF COMMISSIONERS THAT THEY APPROVE A

WHEREAS, the Monroe County Planning Commission during a
regular session held on June 6th, 1991, conducted a public hear-
ing on a proposed Land Use District Map Amendment to change the
Land Use Designation from URBAN RESIDENTIAL MOBILE HOME (URM) to
URBAN RESIDENTIAL MOBILE HOME-LIMITED (URM-L) for property known
as Venture Out at Cudjoe Key, Inc. Lots 1 thru 659, Section 34,
Township 66 South, Range 28 East, Tallahassee Meridian, Monroe
County, Florida, and located at approximately Mile Marker 23 . ; and
WHEREAS, the Planning Commission was presented with informa-
tion via the following:
1 . The Land Use District Map Amendment application as submitted
by the Monroe County Planning Department; and
2 . The Planning Department staff report prepared by Ms. Dianne
Bair, Monroe County FEMA Coordinator/SPC; and
3 . The memorandum by Ms. Bair dated April 24th, 1991, which
addresses the proposed map amendment; and
4. The Memorandum from Robert Herman, Director of the Growth
Management Division, to the Planning Commission which is
dated June 7th, 1990, and which is a history and background
of the URM-L designation; and
5. The letter from the Federal Emergency Management Agency
(FEMA) dated January 13th, 1988, to Robert Herman, Director
of the Growth Management Division, concerning the URM-L desig-

9. The testimony of Mr. James McRoy, who spoke in support of the
proposed map amendment; and
WHEREAS, the Planning Commission has made the following Find-
ings of Fact and Conclusions of Law:
1. That Venture Out at Cudjoe Key, Inc . currently has a Land Use
Designation of URBAN RESIDENTIAL MOBILE HOME (URM) : and that
2 . Venture Out consists of only mobile homes being used as resi-
dential structures; and that
3 . Venture Out meets the criteria for receiving the Land Use
Designation of URBAN RESIDENTIAL MOBILE HOME-LIMITED (URM-L) ;
and that
4. By designating Venture Out as URM-L, manufactured homes would
be able to continue to be established or replaced below the
FEMA established base flood elevation; and that
5. There was no testimony offered at the public hearing in oppo-
sition to the proposed map amendment; and that
6. There were not sufficient written statements in opposition to
the proposed map amendment to invoke the four-fifths (4/5th)
rule at the Board of County Commissioners hearing; NOW THERE-

FLORIDA, that the preceding Findings of Fact and Conclusions of
Law, support their decision to recommend to the Monroe County
Board of Commissioners that they APPROVE the proposed Land Use
District Map Amendment to change the Land Use Designation from
URBAN RESIDENTIAL MOBILE HOME (URM) to URBAN RESIDENTIAL MOBILE
HOME-LIMITED (URM-L) for property known as Venture Out at Cudjoe

Subject "Venture Out" Map Amendment
This is to inform you that approximately six hundred and
fourteen ( 614) certified notices, with response cards enclosed,
were mailed out to the property owners of "Venture Out" . A total
of two hundred and twenty five ( 225) homeowners responded with no
objection. Six ( 6) homeowners objected. Three hundred and twen-
ty seven ( 327) homeowners did not respond. Thirty one ( 31) were
undeliverable. Sixteen O ') are unaccountable, they were mailed
out but no response at all.
In reference to the approximate 126 adjoining property own-
ers. The same response cards were included in their notices. We
received a total of twenty one (21) returns. Five ( 5) objected.
Seven ( 7) had no objection. Nine ( 9) were undeliverable.

SUMMARY:
This area is a 100 % pure mobile home park, with approximately 108
vacant lots out of 659 . The trend in this park is to remain Mobile
Home and it currently has a land use designation of (URM) Urban Resi-
dential Mobile Home. There has been no intrusion of Single Family
Residences, and park regulations prohibit their construction. The
purpose of amending this land use designation from URM to URM-L is to
recognize this park as a pure mobile home park and lawfully continue
to permit the property owners to replace or establish manufactured
homes below the base flood elevation as authorized by codified feder-
al regulations.

SUBJECT: History And Background of Urban Residential Mobile Home
Limited (URM-L) Land Use Designation Changes
On October 1, 1986 The Federal Emergency Management Agency print-
ed a final rule in the Federal Register which amended 44 CFR
provision 60.3 (c) (6) and required that all manufactured homes be
placed or substantially improved in accordance with the elevation
requirements of the zone. This rule was suspended by a notice
published in the Federal Register on June 30 , 1987 and this sus-
pension extended through October 31, 1989. On May 19 , 1989 FEMA
published for comment a proposed rule which would revise NFIP
Floodplain management criteria on placement and substantial im-
provements of manufactured homes on sites in existing manufac-
tured home parks and subdivision.
Prior to developing this proposed rule, FEMA reviewed the com-
ments submitted, and conducted further research into the impacts
of flooding on existing manufactured home parks and subdivisions,
and developed a report for Congress entitled "National Flood
Insurance Program: Report on Existing Manufactured Home Parks
and Subdivisions" . The report concluded that there were alterna-
tives to the October 1986 rule revision that would reduce the
economic impacts on the owners and residents of existing manufac-
tured home parks and subdivisions, yet still achieve the NFIP
objectives of reducing flood damages and threats to public safety.
The proposed rule represented a compromise that was intended to
minimize adverse economic impacts on the manufactured home commu-
nity while at the same time substantially achieved__the ,NFIP objec-
tives of reducing. loss. of life rand property. •The_rule which was
cdeveloped_ was _basically_ ___grandfathering" in existing pure mo-
bile _home parks and subdivisions. It allows for the placement
and substantial improvement of mobile homes within. pure parks at
'36 inches -above _grade or base flood elevation, whichever - is low-
;,er. However, manufactured homes place or substantially improved
on sites in an existing manufactured home park or subdivision on
which a manufactured home has incurred substantial damage as the
result of a flood, would now be required to elevate to or above
the base flood elevation.
Monroe County encountered a problem in that the (URM) Urban Resi-
dential Mobile Home District provided as of right, the construc-
tion of single family dwellings. This was directly in conflict
with the FEMA rule on pure manufactured home parks and the 36"
provision. If the intrusion of single family dwellings was to

As a result of Monroe County' s Community Assistance Visit by the
Federal Emergency Management Agency in 1987, it was agreed to by
the County, to identify all parks and subdivisions that consist
exclusively or almost exclusively of mobile homes, if the issu-
ance of permits for placement below the base flood elevation were
allowed to continue. Venture Out is currently zoned Urban Resi-
dential Mobile Home (URM) . This land use district allows single
family residences as well as mobile homes, and it means that any
replacement or placement of a mobile home would have to meet the
base flood elevation just as a single family residence would.
A new land use district was created and became effective in Janu-
. ary of 1990 called Urban.. Residential Mobile . Home. Limited
(URM-L) . This district limits the mobile home park or subdivi-
sion strictly to mobile homes, and prevents the placement of
single family residences. Therefore, the mobile homes may be
placed or replaced below the base flood elevation.
Venture Out' s bylaws prohibit the construction of single family
residences within the park, therefore, it should correctly be
designated Urban Residential Mobile Home-Limited (URM-L) in order
to be consistent with it' s past and present use.
That is what this notice of public hearing for Venture Out is

Dear Mr. Herman :
In response to your letter of December 28 , 1987 , and our phone
conversation concerning the issue of "existing" manufactured home
parks and subdivisions .s . we ol•I'c'r• the l•olluwing comments.
One of the deficiencies we identified during our Community
Assistance Visit in September that numerous manufactured home
parks and subdivisions contained conventional built structures .
We requested that the County identify those manufactured home
parks that are used exclusively for the placement of manufactured
homes .
As you have indicated, after preliminary investigation, you have
identified over 100 manufactured home parks . of which the
majority contain conventional structures . This is a result of
past zoning practices which have allowed this mixed use .
•
The National Flood insurance Program ( NFIP) h.1 •. treated
"existing" manufactured home parks and subdivisions differently
than conventional structures since December 1 , 1976 , by virtue of
the "grandfather" provision . This provision allows manufactured
homes to be placed in existing manufactured home parks or
subdivisions without elevating the lowest floor to the base flood
elevation ( BFE) . This "special treatment" of existing parks was
to allow park owners to amortize their investment ( roads ,
utilities , pads . etc . ) . Ibis provision was never intended for
conventional structures or individual manufactured homes in mixed
use areas .
All buildings constructed after June 15 . 1973 , whether
conventional , mobile ( manufactured) homes on individual lots , in

mixed use areas . and in mobile ( manufactured) home parks or
subdivisions established on or after December 1 . 1976 , should
have met new construction Regular program requirements .

. be allowed into manufactured home parks, then manufactured homes
would be required to be built to or above the base flood eleva-
tion.
In order to utilize the new 36" provision for existing manufac-
tured home parks and promote continued affordability within mo-
bile home districts, we created a text amendment providing for
(URM-L) Urban Residential Mobile Home Limited. This would limit
the district to Mobile Homes and Recreational Vehicles only, and
allow replacement without meeting the base flood elevation. In
districts remaining URM, where single family residences could
continue as of right, all structures including manufactured homes
must meet or exceed base flood elevation.
Monroe County has completed a study, locating and identifying all
existing manufactured home parks and subdivisions under the cur-
rent land use district of URM and RV ( the RV parks that are tied
down, not road ready, used as residences and have existed in this
manner for numerous years) . Of these current URM and RV dis-
tricts, some may be considered for a change in designation to
URM-L. We will prepare reports and submit them to you for recom-
mendation to the Board of County Commissioners.
During the public hearings, the residents and property owners
themselves should have the most significant impact on the deci-
• = sion of a change in designation to URM-L for their park or subdi-
vision. There are not any planning issues involved as these are
all existing URM and RV districts. However in an area where

the trend is to replace mobile homes with single family homes,
and the majority of the residents prefer URM, their voice should
be the determining factor. It is the intention of the depart-
ment to submit these individual parks or subdivisions on a one at
a time basis because of the large number of citizens that will
attend and speak for the record. I also am asking your consider-
ation in conducting the public hearing at the RV park or manufac-
tured home subdivision when it has a meeting hall available.

Section 9.5-511 (5) ACTIONS BY BOARD OF COUNTY COM1rIISSIONERS •
FOLLOWING PUBLIC HEARING(s) :
Findings based on factors i through vi regarding changes to the
land use district map
i. A change of land use district from Urban Residential Mobile
Home (URM) to Urban Residential Mobile Home Limited (URM-L) will
not change projections with regard to public service needs.
This subdivision is pre 1974 and is substantially built out.
ii. There are no changed assumptions. A change to URM-L will
not affect the existing density. This is an existing substan-
tially built out condominiumized park, and original assumptions
relative to future growth projections were based on this park as
it currently exists.
iii. The data error would be in mapping. This existing
condominiumized park is not consistent with the URM district as
its own bylaws prohibit single family residences. The URM land
use is not in keeping with the community character as described
in Volume I , because that district permits single family residenc-
es. Under the old code this park was zoned RU-8. Only the `
RU-5 district permitted a combination of mobile homes and single
family residences. Finally, the subdivision' s lots were not
platted to accommodate single family homes. •
iv. New issues are that as a result of Monroe County' s Communi-
ty Assistance Visit (CAV) by FEMA in 1987 a new land use designa-
tion was adopted (URM-L) in the third round amendment process
which became effective in January 1990. The purpose of the
URM-L district is to recognize the existence of parks and subdivi-
sions, such as Venture Out, which consist exclusively or almost
exclusively of mobile homes, but not to create new ones, in order
to permit property owners in such areas to replace or establish
mobile homes below the base flood elevation.
v. The recognition of a need for additional detail or compre-
hensiveness is necessary in order to distinguish between 100%
pure mobile home parks with the ability to replace the mobile
home below the base flood elevation and other districts in which
both single family residences and mobile homes are allowed but
must meet or exceed the base flood elevation.
vi. Data concerning mobile home parks has been updated by the
by the extensive study undertaken by the Monroe County Growth
Management Division dated July 1988.
vii. A change in land use designation from Urban Residential _
Mobile Home to Urban . Residential Mobile Limited Home will not
result in adverse community change within the planning area.

Therefore , an existing park qualifies for the benefit of the
"grandfather" provision only if exclusively zoned and permitted
for manufactured homes . - As previously mentioned, the allowance
of conventional structures in these park;, Lhrough the County
Zoning Ordinance clearly shows there has been no effort on the
County' s part to establish true existing manufactured home parks
or subdivisions .
You have suggested one means of rosolviug this issue is for thhe
County Commission to identify those parks and subdivisions that
are a majority of manufactured hume•s , and pass an ordinance which
would prohibit further construction of conventional structures in_
these identified parks , then declare the existing conventional
structures therein non-conforming structures . This means if
these conventional structures were ever replaced. for whatever
reason, they would have to be replaced by a manufactured home.
The benefit of this action would hc that the park would be
classified as an ".-xisting" manufactured .home park and enjoy the
grandfather provision . As previously advised. provided you have
the authority under state law. we would accept this approach.
The only other meats of resolving this issue that we or our
national office can suggest , after researching the issue, is to •
establish a new zoning district for manufactured home parks or
subdivisions . Determine which, if any, URM parks or subdivisions
would meet the definition of the new district ( i .e. , divided into
two or more manufactured home lots for rent or sale ) ; declare
those that meet the requirements :and established prior to
December 1 , 1976 , to be existing manufactured home parks (with
grandfather clause ) ; recognize that all manufactured homes placed
since June 15 , 1973 ( date Monroe County was accepted into Regular
phase of the NFIP and BFE established ) were improperly allowed
below the base flood elevation through administrative error or
improper interpretation of ordinance ; and require that all future
replacements meet new construction requirements .
