Item R2 NOTICE OF INTENTION TO CONSIDER ADOPTION OF COUNTY ORDINANCE NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on Wednesday, September 19, 2001, at 3:00 PM at the Marathon Government Center, 2798 Overseas Highway, Marathon, Monroe County, Florida, the Board of County Commissioners of Monroe County, Florida, intends to consider the adoption of the following County ordinance: AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, PROHIBITING PARKING ON COUNTY ROADS DURING CERTAIN TIMES FOR THE PURPOSES OF STREET CLEANING; PROVIDING THAT PARKING PROHIBITION FOR STREET CLEANING PURPOSES IS NOT EFFECTIVE UNTIL OFFICIAL SIGNS STATING THE PARKING PROHIBITION HAVE BEEN IN PLACE FOR THIRTY DAYS; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person decided to appeal any decision made by the Board with respect to any matter considered at such hearings or meetings, he will need a record of the proceedings, and that, for such purpose, he may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. a) The operator of a motor vehicle may not park the motor vehicle on the shoulder of any County roadway during the time and date that official signs prohibit parking for the purposes of cleaning the road and the road shoulders. b) The prohibition on parking for street cleaning purposes is not effective on any County road, or section thereof, until the County Public Works Division has posted the County road, or a section of the road, with official signs that read substantially as follows: NO PARKING ON THE (for example. Third Tuesday) OF EACH MONTH BETWEEN THE HOURS OF AND FOR STREET CLEANING. VEHICLES IN VIOLATION MAY BE TICKETED OR TOWED. Section 2. a) After the no-parking signs described in section one have been in place for 30 days, the operator of a motor vehicle parked in violation of section one may be issued a County parking ticket by a law enforcement officer or parking enforcement specialist, either in person or by placing the parking ticket on the motor vehicle, as provided by law. Responsibility for the payment of the parking ticket is as provided by general law. b) If the operator of the vehicle parked in violation of section one refuses to move the motor vehicle, or the motor vehicle is inoperable, a law enforcement officer may have the motor vehicle towed and stored at the owner of the motor vehicle's expense pursuant to Sec. 11-7, Monroe County Code. Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
