ITEM BACKGROUND: The first public hearing or "transmittal" hearing was held on November 21, 2000. At that meeting, the BOCC recommended approval to amend the Monroe County Comprehensive Plan. The Planning Department, upon the instruction of the BOCC, transmitted the proposed amendment to the Department of Community Affairs (DCA) for its consideration. On November 9, 2001, the DCA notified the BOCC that they had reviewed and raised no objections to the proposed amendments for Monroe County (DCA No. 01-2). The Monroe County Board of County Commissioners in 1993 and 1994 directed the development of a cultural plan for Monroe County. The Board recognized the important of arts in Monroe County when it designated the Monroe County Council of the Arts Corporation as the official local arts agency for Monroe County through Resolution HI34-1997. The Monroe County Planning Department developed this Cultural Resources Element with Goal 1501, in response to the BOCC. This Cultural Resources Element with its included Goal will provide the necessary means for implementation of a Cultural Plan for the residents and visitors of Monroe County. The Monroe County Planning Department determined that an amendment to the Monroe County Year 2010 Comprehensive Plan as the appropriate measure to address the current deficiencies in the Monroe County Year 2010 Comprehensive Plan. WHEREAS, the Monroe County Planning Commission, during regular meetings on September 27,2000 and October 11,2000, conducted public hearings on a proposed amendment to the Monroe County Year 20 I 0 Comprehensive Plan adding a Cultural Resources Element Consisting of a new Goal 1501 and subsequent Objective and Policies; and WHEREAS, in 1992 and 1994 the Monroe County Board of County Commissioners directed the development of a cultural plan for Monroe County; and WHEREAS, the Monroe County Board of County Commissioners recognized the importance of arts in Monroe County when it designated the Monroe County council of the Arts Corporation as the official local area agency for Monroe County through Resolution H134-1997; and WHEREAS, the Monroe County Council of the Arts Corporation prepared a Cultural Planning Report in November 1998 outlining a profile and needs analysis of the Keys arts community, which was approved by the Monroe County Board of County Commissioners on December 8,1999; and WHEREAS, goal 101 of the Monroe County Year 20 I 0 Comprehensive Plan directs the County to manage future growth, to enhance the quality of life, ensure the safety of County residents and visitors, and protect valuable natural resources; and WHEREAS, the Monroe County Year 20 I 0 Comprehensive does not provide specific Goals, Objectives, or Policies supporting Cultural Resources; and WHEREAS, The County Commissioners made the following conclusions: I. This text amendment is the appropriate action for Monroe County to ensure the protection of cultural resources within Monroe Cmnty. 2. The proposed text amendment supports Goal 101 of the Monroe County Year 20 I 0 Comprehensive Plan, directing the County to enhance the quality of life for County residents and visitors. 3. The proposed text amendment is not in conflict with the existing Goals, Objectives, and Policies of the Monroe County Year 20 I 0 Comprehensive Plan. 4. The proposed text ame:1dment supports Chapters 163 and 380 of the Florida State Statutes. Objective 1501.1 Monroe County shall ensure that arts opportunities and knowledge of cultural resources are available to County citizens and visitors. Policy 1501.1.1 Monroe County shall support and encourage the development of local cultural organizations, facilities, and services that are dedicated to unique and significant cultural themes. Policy 1501.1.2 Monroe County shall ensure local cultural organizations, facilities, and services are readily accessible to its citizens and visitors wherever feasible. Objective 1501.2 Monroe County shall be a steward of cultural resources. Policy 1501.2.1 Monroe County shall maintain a current list of cultural facilities within the county. Policy 1501.2.2 Monroe County shall promote the availability of are and culture for Monroe County citizens and visitors through the use of public buildings and properties, and encourage shared, multipurpose use of those facilities for cultural activities to maximize their efficient use. Policy 1501.2.3 Monroe County shall support the transmission of the regional cultural legacy, cultural education, ant the preservation and celebration of cultural diversity and creativity. Objective 1501.3 Monroe County shall encourage Interlocal Agreements to maximize cultural opportunities for County citizens and visitors when such agreements could result in outstanding cultural opportunities for the County. Policy 1501.3.1 Monroe County shall coordinate with other local government entities and local arts organizations to ensure a role for arts and culture within the County. Policy 1503.3.2 Monroe County shall support private/public partnerships that provide arts and cultural programs for County citizens and visitors in any appropriate way oossible. The staff report prepared by Pat Small, Planner, dated February 9,2000; and 2. Comments made by the Development Review Committee; and WHEREAS, the Development Review Committee made the following findings: 1. Mayor Shirley Freeman a..Tld the Monroe County Council of the Arts requested an amendment to the Monroe County Year 2010 Comprehensive Plan supporting a Cultural Resources Element. 9. The Monroe County Planning Department prepared a new Goal and subsequent related Objectives and Policies to add a Cultural Resource Element to the Monroe County Year 2010 Comprehensive Plan. 10. The proposed amendment to the Monroe County Year 2010 Comprehensive Plan does not conflict with any of the existing Goals, Objectives, or Policies currently in the Comprehensive Plan. 11. According to Section 9J-5 of the Florida Administrative Code, the proposed amendment to the Monroe County Year 2010 Comprehensive Plan would be regarded as an optional element in the Comprehensive Plan. 12. Section 9J-5 of the Florida Administrative Code listing criteria for Comprehensive Plan amendments does not set out criteria for optional elements in Comprehensive Plans. 13. According to Section 163.3177 of the Florida State Statutes, coordination of Comprehensive Plan elements shall be a major objective of the planning process. 14. The proposed amendmer.( to the Monroe County Year 2010 Comprehensive Plan supports Goal 101 of the Comprehensive Plan, directing the County to enhance the quality of life of County residents and visitors. 15. Chapter 380 of the Florida State Statutes outlines Principles for Guiding Development. 16.
