ITEM BACKGROUND: The BOCC approved NROGO is currently being reviewed by DCA. Because of the time it has taken to adopt and have this ordinance approved by the state planning agency, applicants have been unable to prepare proposals for non-residential floor area that they can be sure will be acceptable. In the interest of fairness, the Planning Director is recommending this extension of time for the first allocation. PREVIOUS REVELANT BOCC ACTION: The Board of County Commissioners in September 2001 adopted the Non-residential Rate of Growth Ordinance. On August 16, 2001, Resolution 317-2001 provided for the first annual allocation of 22,500 square feet to be made available in two allocations the first allocation of 11,150 square feet on January 1,2002. WHEREAS, Policy 101.3 of the Monroe County Year 2010 Comorehensive Plan (2010 Plan) requires Monroe County to regulate non-residential development to maintain a balance of land uses; and WHEREAS, residential development has continued since implementation of the Plan in January 1996 and by December 2000 had equaled the non-residential permits issued before January 1996; and WHEREAS, the amount of non-residential floor area available through July 2002 for allocation in NROGO is 44,300 square feet; and WHEREAS, Section 9.5-124 Non-residential rate of growth ordinance (NROGO), adopted by the Board of County Commissioners on September 19, 2001, provides for an allocation point system for non-residential floor area, which maintains the ratio of 239 square feet of non-residential floor area for each residential unit developed as required in the 2010 Plan; and WHEREAS, On August 16, 2001 the Board of County Commissioners adopted Resolution #317-2001 providing that the first annual allocation of non-residential floor area be limited to applications of two thousand five hundred (2,500) square feet or less and that twenty-two thousand one hundred and fifty square feet (22,150) be made available in two allocations, the first allocation of 11,150 feet on January 1,2002 and the remainder to be held in reserve for the second allocation period of July I, 2002; and WHEREAS, The approved NROGO is currently being reviewed by the Department of Community Affairs and will only become effective upon the approval of the state planning agency as provided for in Florida Statutes Chapter 380.0552; and WHEREAS, the first annual allocation date was proposed for January 1, 2002, which does not provide sufficient time for applicants to submit completed, reviewed plans for consideration for NROGO; and WHEREAS, the Planning Director recommends that the first allocation date be deferred until February 1, 2002 to provide additional time for applicants to prepare submittals for NROGO; NOW THEREFORE; BE IT RESOL YED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the date for the first annual allocation award of non-residential floor area is deferred from January 1,2002 until February 1,2002.
