A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS APPROVING EXEMPTION FROM THE NON-
RESIDENTIAL PERMIT ALLOCATION SYSTEM PURSUANT TO
POLICY 101.3.4 OF THE MONROE COUNTY YEAR 2010
COMPREHENSIVE PLAN FOR THE MOTE MARINE LABORATORY,
INC. FOR CHANGING THE USE OF THE SECOND FLOOR OF A
BUILDING FROM A COMMERCIAL APARTMENT TO A MARINE
LABORATORY. THE PROPERTY IS LOCATED OFF U. S. HWY 1 LOT
17 BLOCK 2 SUMMERLAND KEY COVE ADDITION NO.2,
SUMMERLAND KEY, MONROE COUNTY, FLORIDA. THE LAND USE
DESIGNATION IS SUBURBAN COMMERCIAL AND THE REAL
ESTATE NUMBER IS 00190900.000000.
WHEREAS, Policy 101.3.4 of the Year 2010 Comprehensive Plan allows the Board of
County Commissioners to exempt federally tax-exempt non-profit organizations from the
nonresidential permit allocation system after a finding by the Planning Commission that such
activity will not adversely affect the hurricane evacuation objectives of the Comprehensive Plan;
and
WHEREAS, Mote Marine Laboratory INC. has requested an exemption from the non-
residential permit allocation system; and
WHEREAS, during a regular meeting held October 10, 2001, the Monroe County
Planning Commission conducted a public hearing on the request of the Mote Marine Laboratory,
Inc. for an exemption to the non-residential permit allocation system for changing the use of the
second floor of a building from a commercial apartment to a marine laboratory; and
recommended approval of the request to the Board of County Commissioners based on the
following findings of fact and conclusions of law:
1. Mote Marine Laboratory, Inc. is a federally tax-exempt non-profit organization; and
2. An exemption to the non-residential permit allocation system pursuant Monroe County
Year 2010 Comprehensive Plan Policy 101.3.4 is required to change the use of the
second floor of a building from a commercial apartment to a marine laboratory ; and

3. This laboratory is considered an institutional use and permitted as-of-right III the
Suburban Commercial (SC) land use district; and
4. The proposed change of use will add 779sf of floor space to institutional use; and
5. The proposed change of use of the floor space will not have any impact on hurricane
evacuation time as the commercial apartment use is being vacated; and
6. The institutional use must comply with County level of service standards and all
applicable land development regulations and the Monroe County 2010 Comprehensive
Plan prior to development approval; and
7. Pursuant to approval of the exemption by the Monroe County Board of Commissioners,
the applicant will possess a transferable development right that is not effected by ROGO.
8. The Transfer of Development Rights process requires a pre-application conference and
Minor Conditional Use approval for the sender site and receiver site;
Therefore, we conclude that based on numbers 1-8 above, that Mote Marine Laboratory Inc. will
not adversely affect the hurricane evacuation objectives of the Year 2010 Comprehensive plan;
and
WHEREAS, the Board of County Commissioners has duly considered the
recommendations and findings of fact and conclusions of law of the Planning Commission
adopts them as their own; NOW THEREFORE,
BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS, that the preceding Findings of Fact and Conclusions of Law, support their
decision to APPROVE to the request filed by Mote Marine Laboratory Inc. as a federally tax-
exempt, non-profit organization, for an exemption to the non-residential permit allocation system
pursuant to Policy 101.3.4 of the Monroe County Year 2010 Comprehensive Plan.
