Consideration of a revision to the cesspool identification and elimination area list and maps to
exclude any area on Little Torch Key
ITEM BACKGROUND:
Based on adoption of Ordiance 031-1999, Cesspool Identification and Elimination Areas must be
defined. The first list of Cesspool Identification and Elimination Areas was adopted by the
BOCC in November of 1999. A small area on Little Torch Key was identified as part of one of
these areas. After additional consideration by the staff and wastewater management consultant,
ALL of Little Torch Key is more appropriately identified as a "hotspot," which will be
recommended for a future wastewater collection system. To include this small area of Little
Torch Key, Torch Key Estates and Leeward Acres, in the "hotspot" as opposed to the Cesspool
Identification and Elimination Area is more efficient and cost effective for residents of the
affected area.

Introduction
Up request, staff reevaluated the area of Little Torch Key which is currently
included as part of the Ramrod/Torch Keys Cesspool Identification and
Elimination Area (CIEA). Mer reevaluation, staff recommends that this area be
excluded from the Ramrod/Torch Key CIEA.
Background
The area in question includes Torch Key Estates and Leeward Acres. The two
subdivisions and surrounding acreage, which are included in a CIEA, contain
approximately 250 lots, approximately 12 of which are developed and contain 2
unknown systems. The County or state otherwise owns much of the land. A
property owner living in the area requested the reevaluation.
The remaining area of Little Torch Key will most likely be recommended for a
centralized wastewater collection and treatment system. Subdivisions on Little
Torch are fairly well built out at this time, homes are generally a little older than
in other areas, and there are 152 unknown systems on the island. The cost of
construction for this system will be comparatively low per unknown system
replaced. This will give it a high priority for centralized treatment system
construction in the future.
Analysis
In the initial consideration of the Ramrod/Torch Key CIEA, it was understood that
the Torch Key Estates/Leeward Acres had relatively few homes and a large

number of lots, all on relatively unimproved roads. It was assumed that the roads
were privately owned and maintained. Thus, staff believes that it would probably
not be included in of any centralized wastewater improvements on Little Torch
Key.
Further review indicated that the roads are county roads and access for
improvement of the area should not create a problem. A wastewater collection
system will be recommended for Little Torch, to include the majority of the
island. The primary collection system will run along State Road 4A, which front
on the two subdivisions in question. Thus, the addition of this area to the overall
collection system plans is a reasonable option.
The cost benefit to the homeowners in the Torch Key and Leeward Acres area is
the primary issue. Little additional cost per unit will result from adding this area
to the overall area for the collection system. On the other hand, costs to the
individuals in the two subdivisions who would otherwise receive an "unlmown
system" letter would be considerable higher over the long term, even with a
grant subsidy if an on-site wastewater system were installed. Thus, it makes
sense to remove these two subdivisions (Torch Key Estates and Leeward Acres)
and all other parts of Little Torch Key from the Ramrod/Torch Keys CIEA. The
additional benefit of this action will be that when the centralized wastewater
system is installed, all of the other homes within the two subdivisions will be
required to upgrade as well.
In informal discussion with the developed property owners within Torch Key
Estates and Leeward Acres, indicates that they favor being removed from the
CIEA designation.
Recommendation
Staff recommends that all areas of Little Torch Key be removed from the
Ramrod/Torch Keys Cesspool Identification and Elimination Area.

RESOLUTION NO. 1999
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COMMISSIONERS REVISING THE LIST OF CESSPOOL
IDENTIFICATION AND ELIMINATION AREAS (CIEA) TO
EXCLUDE ALL AREAS OF LITTLE TORCH KEY FROM THE
CIEA LIST.
WHEREAS, the Board of County Commissioners (BOCC) adopted
Ordinance 031-1999 on 22 July 1999 which significantly revises Chapter 15.5,
Monroe County code, concerning cesspool identification and elimination in
unincorporated Monroe County; and
WHEREAS, said Ordinance requires the development of a list of "Cesspool
Identification and Elimination Areas" to be adopted by resolution of the BOCC on
dates subsequent to the adoption of the Ordinance; and
WHEREAS, the BOCC adopted an initial list of Cesspool Identification and
Elimination Areas at its November 1999 regular Board meeting; and
WHEREAS, it has been subsequently determine that the no area of Little
Torch Key should be included within a Cesspool Identification and Elimination
Area; and
WHEREAS, said determination is based on an assessment of general cost
benefits to those in the affected area, a reassessment of public/private rights-of-
way in the affected area, and the number of developed properties and unknown
systems in the area.
THEREFORE, BE IT RESOL VED BY THE BOARD OF COUNTY
COMMISSIONERS, MONROE COUNTY, FLORIDA THAT:
I. the following attachments, Table I and attachment I, identifying the
modification to the Ramrod/Torch Keys Cesspool Identification and
Elimination Area (known as TR1) serve to modify the list of Cesspool
Identification and Elimination Areas; and

2. this list of Cesspool Identification and Elimination Areas is subject to
change, such that additional areas may be added to or subtracted from the
list at a later date, as contemplated in Ordinance 031-1999; and
3. use of this list for the purpose of implementation of Ordinance 031-1999
shall have an effective date of no sooner than I January 2000.
PASSED AND ADOPTED by the Board of County Commissioners,
Monroe County, Florida at a regular meeting of said Board held on the 20th day
of January, A.D., 2000.
