AGENDA ITEM WORDING:
Approval to advertise an ordinance reorganizing the Division of Public Safety.
ITEM BACKGROUND:
At a meeting on April 19, 2001, the Board of County Commissioners decided to reorganize the
Division of Public Safety according to proposals made by the Administration. This ordinance is the
next step in that reorganization.

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, CREATING THE FIRE RESCUE AND EMERGENCY
MEDICAL SERVICES DEPARTMENT; PROVIDING FOR THE MANAGEMENT
OF THE DEPARTMENT; PROVIDING THAT FIRE RESCUE AND EMERGENCY
MEDICAL SERVICES VOLUNTEER PERSONNEL ARE VOLUNTEERS TO THE
COUNTY; CREAnNG THE EMERGENCY MANAGEMENT DEPARTMENT;
PROVIDING FOR THE MANAGEMENT OF THE DEPARTMENT; PROVIDING
FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES
INCONSISTENT HEREWITH; PROVIDING FOR INCORPORAnON INTO THE
MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA:
Section 1.
There is hereby created a Fire Rescue and Emergency Medical Services
Department (Fire/EMS Department). The Fire/EMS Department duties are organized as follows:
a) There shall be a Department head responsible for managing the Fire/EMS
Department. The Department head shall report to the County Administrator. The Department
head shall solidt advice in managing the Department from an advisory board consisting of the
volunteer tire chiefs, a representative selected by the union repl'l!senting the paid fire and EMS
employees, and citizen representatives selected by the BOCC. All advisory board/Department
head meetings, or meetings of the advisory board members, are public meetings under Sec.
286.011, Fla. Stat.
b) The Department is subdivided as follows:
(i) the County Fire Marshal Fire Prevention Department; and
(ii) County Fire-EMS Operations section.
c) The Fire Marshal shall be the administrative head of the Fire Prevention Department
and shall report to the Fire/EMS Department head.
d) There shall be an administrative head of the Fire/EMS Operations section who shall
report to the Fire/EMS Department head.

e) All volunteer fire rescue and EMS personnel are volunteers directly to the County
and are subject to the supervision of the County executive employees, or their designees, who
have managerial authority over the services furnished by the volunteer personnel.
f) As authorized by Chapter 2, Monroe County Code, and Sec. 125.74, Fla. Stat., and
when consistent with this Section 1, the County Administrator is authorized to adopt all such
rules, job descriptions, duty assignments, and administrative orders that he determines are
necessary to effectuate the provisions of this Section 1. To the extent provided by the annual
budget adopted by the BOCC and as authorized by Chapter 2, Monroe County Code, and Sec.
125.74, FS, the County Administrator is directed to employ such personnel as he determines are
necessary to effectuate the provisions of this Section 1.
Section 2.
There Is hereby created an Emergency Management Department.
a) There shall be a Department head responsible for managing the Department. The
Department head shall report to the County Administrator.
b) The Department is subdivided as follows:
(i) the Emergency Management Operations department which is also the
agency required by Sec. 252.38, FS; and
(II) the Communications Systems department.
c) As authorized by Chapter 2, Monroe County Code, and Sec. 125.74, FS and when
consistent with this Section 2, the County Administrator is authorized to adopt all such rules, Job
descriptions, duty assignments and administrative orders, that he determines are necessary to
effectuate the provisions of this Section 2. To the extent authorized by the annual budget
adopted by the BOCC and as authorized by Chapter 2, Monroe County Code, and Sec. 125.74, FS,
the County Administrator is directed to employ such personnel as he determines are necessary to
effectuate the provisions of this Section 2.
Section 3.
If any section, subsection, sentence, clause or provision of this ordinance is
held invalid. the remainder of this ordinance shall not be affected by such invalidity.
Section 4.
All ordinances or parts of ordinances In conflict with this ordinance are
hereby repealed to the extent of said conflict.

Section 5.
The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform numbering system of the Code.
Section 6.
This ordinance shall take effect immediately upon receipt of official notice
from the Office of the Secretary of State of the State of Rorida that this ordinance has been filed
with said Office.

FIRE/EMS EXECUTIVE OFFICER ADDED
Replaces Senior Fire Rescue Director position.
FY 2001 salary in budget is $51,680 plus benefits which totals $72,577. $ 0
SENIOR DIRECTOR OF EMERGENCY MANAGEMENT
POSITION ELIMINATED
FY 2001 salary is $56,661plus benefits, which totals approximately
$77,300. A special grant covers approximately 15% of the salary,
and those funds will be utilized to subsidize another Emergency
Management salary.

The Board is reminded that between FY 2000 and FY 2001, the County eliminated six
positions in the Fire/EMS budgets with a reduction of $205,240 in salaries and $292,758
total with benefits.

I would definitely make plans to attend this meeting..,but call the
commissioners and cxprcss your displeasure first.
