Ordinance 002-2002 ORDINANCE NO. 002 -2002 AN ORDINANCE AMENDING THE MONROE COUNTY CODE BY THE ADDITION OF TEXT TO SEC.9.5-309 FENCES; PROVIDING FOR THE SEVERIBILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR THE INCORPORATION INTO THE MONROE COUNTY CODE; AND DIRECTING THE CLERK OF THE BOARD TO FORWARD A CERTIFIED COPY OF THIS ORDINANCE TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS AND PROVIDING AN EFFECTIVE DATE WHEREAS, The Monroe County Board of County Commissioners, during a regular meeting held on January 17 2002, conducted a review and consideration of the proposed text; and WHEREAS, the Development Review Committee on November 15, 2001, reviewed the legal authority and the proposed text, and recommended approval of the proposed text; and WHEREAS, during a regular meeting held on December 12, 2001, the Monroe County Planning Commission conducted a public hearing on the proposed text and recommendations of staff, and recommended approval of the proposed text; and WHEREAS, The Monroe County Board of County Commissioners was presented with the following evidence, which by reference is hereby incorporated as part of the record of said hearing; 1. Staffs report prepared on November 8, 2001 by Fred Gross, Island Planning Team Director. 2. Proposed changes to the Monroe County Land Development Regulations; and 3. The sworn testimony of the Growth Management Staff; and WHEREAS, the Monroe County Board of County Commissioners has made the following Findings of Fact and Conclusions of Law based on the evidence presented: 1. There is a need on Stock Island and Key Haven where unsafe living conditions may exist to provide residents with an increased feeling of safety and an improved level of privacy. (iv) New Issues and (V) Recognition of a need for additional detail or comprehensiveness. 3. The proposed change is consistent with the goals of the Monroe County Year 2010 Comprehensive Plan. 4. Based on the principle that "unsafe living conditions" is subjective, the proposed change is in the best interest of improving public safety on Stock Island and Key Haven. 5. On November 15, 2001 at a public meeting of the Development Review Committee, after a review of the staff report, recommended approval of the proposed amendment to the text. 6. On December 12, 2001 at a regularly scheduled public hearing of the Monroe County Planning Commission, after a review of the staff report and sworn testimony of staff, recommended approval of the proposed text. WHEREAS, the Monroe County Board of County Commissioners examined the proposed amendment to the Monroe County Code submitted by the Monroe County Planning Department; and WHEREAS, the Monroe County Board of County Commissioners hereby supports the decision of the Monroe County Planning Commission and the staff of the Monroe County Planning Department; and WHEREAS, it is the desire of the Monroe County Board of County Commissioners that the following amendment to the County Code be approved, adopted and transmitted to the state land planning agency for approval; and NOW THEREFORE; BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT Section 1. Chapter 9.5, Article VII Division 2 is hereby amended to include the following: Sec. 9.5-309. FENCES (a) Height (1) d. On Stock Island and on Key Haven, fences may be constructed to a height of six (6) feet. Page 2 of 4 • Section 2. If any section, subsection, sentence, clause, item, change, or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such validity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall be filed in the Office of the Secretary of State of Florida, but shall not become effective until a notice is issued by the Department of Community Affairs or Administrative Commission approving the ordinance. Section 6. This ordinance shall be transmitted by the Planning Department to the Department of Community Affairs to determine the consistency of this ordinance with the Florida Statutes. The Florida Keys Area is a statutorily designated area of critical state concern, and Monroe County is a local government within the Florida Keys Area. 2. On February 20, 2002, the Department received for review Monroe County Ordinance No. 002-2002 which was adopted by the Monroe County Board of County Commissioners on January 17, 2001 ( "Ord. 002-2002"). Ord. 002-2002 amends Section 9.5-309 of the Monroe County Code to increase the height limitation on fences on Stock Island and Key Haven. 3. Ord. 002-2002 is consistent with the County's 2010 Comprehensive Plan. CONCLUSIONS OF LAW 4. The Department is required to approve or reject land development regulations that are enacted, amended or rescinded by any local government in the Florida Keys Area of Critical State Concern. ~~ 380,05(6) and (11), Fla, Stat" and ~ 380.0552(9), Fla. Stat. (2001). 5. Monroe County is a local government within the Florida Keys Area of Critical State Concern. 9380.0552, Fla. Stat. (2001) and Rule 28-29.002 (superseding Chapter 27F-8), Fla, Admin. Code. 6. "Land development regulations" include local zoning, subdivision, building and other regulations controlling the development of land. 9 380.031 (8), Fla. Stat. (2001), The regulations adopted by Ord, 002-2002 are land development regulations. 7. All land development regulations enacted, amended or rescinded within an area of critical state concern must be consistent with the Principles for Guiding Development (the "Principles") as set forth in 9 380.0552(7), Fla, Stat. See Rathkamp v. Department of Community Affairs, 21 F.A.L.R. 1902 (Dec. 4, 1998), aff'd, 740 So. 2d 1209 (Fla. 3d DCA 1999). The Principles are construed as a whole and no specific provision is construed or applied in isolation from the other provisions. 8. Ord. 002-2002 promotes and furthers the following Principles: (1) To protect the public health, safety, and welfare ofthe citizens of the Florida Keys and maintain the Florida Keys as a unique Florida resource. 9, Ord, 002-2002 is not inconsistent with the remaining Principles. Ord. 002-2002 is consistent with the Principles for Guiding Development as a whole. WHEREFORE, IT IS ORDERED that Ord. 002-2002 is found to be consistent with the Principles for Guiding Development of the Florida Keys Area of Critical State Concern, and is hereby APPROVED.
