A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA DESIGNATING DUCK KEY, EXCLUDING HAWK'S CAY, A
CESSPOOL IDENTIFICATION AND ELIMINATION AREA (COLD SPOT) AND
PROVIDING THAT SUCH DESIGNATION SUPERSEDES ANY PRIOR DESIGNATION.
WHEREAS, Sec. 15.5-17, et seq., provide that the Board of County Commissioners must identify
areas within specific geographic boundaries as cesspool identification and elimination project areas if
appropriate under Chap. 15.5, Monroe County Code (cold spots);
WHEREAS, Duck Key, excluding Hawk's Cay, has previously been designated both a cold spot and hot
spot; and
WHEREAS, it is desired to clarify that Duck Key is a cold spot; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA:
Section 1.
Pursuant to Sec. 15.5-17, Monroe County Code, Duck Key, excluding Hawks Cay, is
hereby designated a cesspool identification and elimination area (cold spot).
Section 2.
The designation provided for in this resolution supersedes and replaces any prior
designations for Duck Key, excluding Hawk's Cay, however made.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a
regular meeting of said Board held on the
day of February, 2002.
