ITEM BACKGROUND:
As part of a FEMA Unmet Needs Grant award to Monroe County through its project sponsor, the FKAA, approximately
$6,3 million in federal and state funds have been designated for a wastewater project in Key Largo, To ensure that these
funds are not lost, the FKAA and Monroe County entered into a Joint Resolution on February 14, 2002, relating to duties
and responsibilities between the two entities for the provision of wastewater facilities in Key Largo [A copy of the
resolution is included in this agenda package.]
In accordance with Section 2 (d) of this Joint Resolution, FKAA has submitted recommendations for provision of
wastewater to the County Administrator (March 5, 2002 letter is included in its agenda package) and requests that the
Board of County Commissioners affirm by resolution the proposed area it wants to be served. The FKAA's primary
recommendation is Key Largo Trailer Village; its secondary recommendation is Key Largo Park/Sunset Waterways. The
physical wastewater treatment facility plant location will be at the MM 100.5 already designated by the BaCC.
The total amount of FEMA grant funds designated for the project is approximately $5.4 million with state and County
matches of approximately $914,000 each. The BaCC has previously budgeted $1.0 million in infrastructure tax funds
(Fund 304) to provide its match,
The staff is recommends that the BaCC affirm the primary recommendation of the FKAA for the reasons presented in its
staff report, which is part of this agenda package.

A RESOLUTION OF THE MONROE COUNTY BOARD OF
COMMISSIONERS AFFIRMING THE RECOMMENDATIONS
OF THE FLORIDA KEYS AQUEDUCT AUTHORITY (FKAA)
FOR PRIMARY AND SECONDARY WASTEWATER
IMPROVEMENT PROJECT AREAS IN KEY LARGO AND
REQUESTING THAT THE FKAA BEGIN WORK
IMMEDIATELY TO FULFILL OUR OBLIGATIONS TO
FEMA FOR RECEIPT OF FEMA UNMET NEEDS GRANT
DOLLARS IN KEY LARGO AT THE PRIMARY
WASTEWATER PROJECT AREA, KEY LARGO TRAILER
VILLAGE.
WHEREAS, FEMA Unmet Needs dollars were awarded and are
available to complete wastewater improvements in the Key Largo area; and
WHEREAS, the BOCC and the FKAA adopted a joint Resolution or
Interlocal Agreement (Monroe County Resolution #093-2002; FKAA Resolution
#02-08) that establishes a series of necessary commitments to secure FEMA
Unmet Needs dollars for a wastewater improvement project in Key Largo; and
WHEREAS, Section 2. (D) of the Interlocal Agreement requires the County
to Affirm with the FKAA an appropriate primary Wastewater Improvement Project
area; and
WHEREAS, the FKAA has recommended a primary and a secondary
Wastewater Improvement Project Area, Key Largo Trailer Village and Key Largo
Park/Sunset Waterways respectively; and
WHEREAS, the priority of the Key Largo Trailer Village area stands well
above the secondary project area for two reasons,
· Greater number of unknown wastewater systems (286 VS 70),
· Higher ranking in the Sanitary Wastewater Master Plan in terms of
nutrient loading (No.2 VS No. 40); and now therefore

INTRODUCTION
At its 14 February 2002 meeting, the Board of County Commissioners adopted a
Joint Resolution with the Florida Keys Aqueduct Authority (Monroe County
Resolution #093-2002; FKAA Resolution #02-08). The Resolution (attached for
the Board's review) stands as aninterlocal agreement, as described in 163.01,F.S.,
between the agencies and
Among the commitments made by the County (Section 2. (D)) was to affirm an
area to be served by a wastewater plant to be located on property at mile mark
100.5. The FKAA's Commitment was to provide a list of areas (hotspots) within
fifteen (15) days of the adoption of the Joint Resolution. They have done that and
the recommendations are attached for the Board's review (see attached letter to the
County Administrator).
This document assesses the recommendations of the Florida Keys Aqueduct
Authority and recommends that the Board affirm the primary and secondary
wastewater project areas provided by the FKAA. These are Key Largo Trailer
Village (primary) and Key Largo Park/Sunset Waterways (secondary). A graphic
of this area of Key Largo is attached for your review.

BACKGROUND:
FEMA Unmet Needs dollars were awarded to Monroe County in the summer of
1999 to offset future hurricane related impacts. These dollars were awarded after
the devastating impacts of Hurricanes Georges and Mitch. Nearly $27 million
dollars were awarded to the County and municipalities to make necessary
improvements in the County to avoid future hurricane damage. Approximately
$10.6 million of these dollars were provided for wastewater improvements.
Wastewater project areas included Key Largo, Conch Key, andBaypoint. Of the
$10.6 million allocated approximately 5.4 million dollars are to be utilized in Key
Largo.
Originally, the FEMA Unmet Needs program funds were to be utilized as part of
the wastewater project encompassing all of Key Largo. This project was
contracted to Ogden Water Systems through the FKAA and was later the subject of
legal action concerning potential violations of the Sunshine Law. As a result of the
legal action, the large scale Key Largo wastewater project has been deferred. As a
further result, the FEMA Unmet Needs funds have not been secured. Resolution
#093-2002 takes the first step towards a new approach toward securing the FEMA
funds, by outlining responsibilities and establishing critical paths and deadlines
toward the completion of a wastewater project in Key Largo.
ASSESSMENT:
The Florida Keys Aqueduct Authority has recommended two potential areas for
use of the FEMA Unmet Needs dollars. These are Key Largo Trailer Village
(primary) and Key Largo Park/Sunset Waterways (secondary).
The FKAA provides a number of technical justifications for their
recommendations, but prefaces them by noting that the previous selection of a
treatment plant site at Mile Marker 100.5 limits potential alternatives. The BOCC
previously selected the 100.5 site for the treatment plant for Key Largo after
extensive public input. This remains a viable site even in a more deliberately
phased and measured approach to providing improved wastewater services to the
Key Largo area. FEMA spent nearly a year reviewing the selection of the 100.5
site and in developing an Environmental Assessment. The time and energy spent
on their part could not be redone if we expect to receive the FEMA Unmet Needs
dollars. Thus, receipt of the FEMA Unmet Needs dollars is predicated on use of
this site as defined by FEMA.

Proximity:
Both Key Largo Trailer Village and the Key Largo Park/Sunset Waterways areas
are relatively close to the treatment site. Thus, they are reasonable alternatives to
upgrade the maximum number of unknown and substandard wastewater systems
with the dollars available. Key Largo Trailer Village is further away
(approximately 1 mile), but for other reasons may be the better choice. The
distance to either area from the treatment plant requires NO ADDITIONAL pump
stations, thus requiring no additional land acquisition or facility siting.
Though a mile away from the plant site, commercial units (approximately 30
EDUs) could be serviced along U.S. Highway 1, if the Key Largo Trailer Village is
selected.
Proximity to Adjacent Areas:
The proposed Wastewater Treatment Plant Site is adjacent to HolidayHomesites
subdivision. With additional financial support, this subdivision could be included
in the project area for either the primary or secondary areas recommended by the
FKAA. It is also fairly highly and has a number of unknown systems. Adjacent
subdivisions are also shown in the following table, identifying the number of lots,
number of unknown systems, number of developed lots, and the rank as identified
in the Wastewater Master Plan.
Two subdivisions are located near Key Largo Trailer Village, Hibiscus Park and
Largo Gardens. Though on the ocean side of the highway, these areas could be
easily added to the service area should additional funds become available Both
are ranked highly for wastewater load and number of unknown systems in the
Wastewater Master Plan.
There are no other subdivisions immediately adjacent to Largo Park/Sunset
Waterways, though if selected first, Key Largo Trailer Village is less than a mile
away.
Priority Ranking:
The Wastewater Master Plan ranked most subdivisions in the Keys for their
nutrient load density, total nutrient load, and density of unknown systems. Key
Largo Trailer Village ranked second (ttd) in the entire Keys for density, third (1d)
for density of unknown systems, and fifth (Sh) for Nitrogen load. The Key Largo

Park/Sunset Waterways area ranked fortieth (4(1h) for density, fifty-third (51d) for
density of unknown systems, and sixtieth (6()'t) for nitrogen load.. At the time of
the ranking, the assessment included the Village of Islands and Marathon.
The table on the following page further outlines these differences, identifying the
total number of lots, the number of developed lots, the number of unknown
systems, and the percentage of developed lots which are unknown systems, as well
as, the information presented above
Number of Properties Served:
Both the primary area and secondary areas suggested by the FKAA encompass 500
units or less. The Key Largo Trailer Village has approximately 50 fewer lots.
With adjacent subdivisions included in the future, the Key Largo Trailer Village
area would encompass just under 1,000 units while the Key Largo Park/Sunset
Waterways area would encompass just under 775.
RECOMMENDATION:
Based largely on the number of unknown systems that would be replaced and the
rank placed on the area in the Sanitary Wastewater Master Plan, for both the
wastewater area and adjacent nearby areas, the Key Largo Trailer Village area
stands well above the Key Largo Park area for importance.
· Considering only the specific areas recommended by the FKAA, Key Largo
Trailer Village contains 286 unknown systems while Key T...,argo Park contains
only 70.
· Considering only the specific areas recommended by the FKAA, Key Largo
Trailer Village is ranked Number 2 for nutrient load density among all
subdivisions considered County-wide. Key Largo Park is ranked number 40.
Staff recommends to the Board of County Commissioners that they affirm the
recommendations of the Florida Keys Aqueduct Authority for primary and
secondary wastewater site in Key Largo. These are
· Primary: Key Largo Trailer Village
· Secondary: Key Largo Park/Sunset Waterways

on the primary area immediately.

SECTION 1. F1NDINGS. It is asceItained, detennined and declared that:
(A) The Florida Keys Aqueduct Authority (the "FKAAn) is a special purpose local
government charged with the authority [0 provide wastewater facilities and services in
unincorporated Monroe County pursuant to a Special Act of the Rorida Legislature under
Chapter 76-441, Laws of Horida. as amended,
(B) Monroe County and the FKAA have entered into various memoranda of
understandiTlg and other agreemems that describe shared responsibilities between Monroe
County and the FKAA for the development of wastewater facilities and services in Monroe
County.

(C) Vnder Public Law 106-31, the Emergency Supplemental Appropriations Act for
fiscal year 1999 (1249 and 1259 Vnmet !'eeds Program), a supplemental appropriation was
made available to ~onroe County for wastewater projects in the Key Largo area. Premised upon
the authority of the FKAA to provide wastewater facilities and services within the
unincorporated portions of Monroe County, the FKAA has been designated as sub-grantee under
the Vnmet Needs Program to receive and expend grant funds for a wastewater project(s) in the
Key Largo area. The Federal Emergency Management Agency (uFEMA") and the State of
Florida Department of Community Affairs ("DCA") are charged with administering grants under
the Vnmet Needs Program.
(D) In order to secure grant funding under the Vnmet Needs Program. FEMA has
advised Monroe County that Monroe County and FKAA must provide a firm commitment to
immediately develop and implement wastewater project(s) in the Key Largo area or the
foregoing grant funds under the Vnmet ~eeds Program will be withdrawn.
(E) Further, FE.J\.1A has advised Monroe County and FK.AA that a firm commitment
to proceed will require the development of a set of "milestones" or critical events to advance,
develop and implement the construction of the contemplated wastewater project(s) in the Key
Largo area and that such ''milestones'. or critical events thereafter must be diligently and timely
accomplished in order to continue to secure grant funding under the Vnmet Needs Program.
(F) It is recognized and agreed that the FK.AA has no independent source of funds for
the Key Largo Wastewater project(s) and is acting hereunder on reliance upon Monroe County
and the Vomet Needs Program in order to fulfill its obligations hereunder.
SECTION 2. MONROE COUNTY COMMITMENTS TO FKAA. In order to
secure wastewater project funding under the Vomet Needs Program for the Key Largo area.
Monroe County commits and agrees as follows:
(A) Monroe County shall immediately appropriate and fund all matching fuod
requirements of local government under the Vnmet Needs Program grant requirements. Monroe
County will forward to FKAA twenty percent (20%) of the required local match upon execution
of this resolution. Such funds to be held by FKA.A as security for the local match in a separate
fund and used for the Key Largo wastewater project(s), and otherwise segregated from all other
funds of the FKAA. Monroe County will su~sequently make local match reimJ:,ursements upon
the approval of the federal/state reimbursements to FKAA. It is the intent of the parties to
recover Monroe County's local match contribution from user fees and/or special assessments.
(B) Monroe County reaffirms and acknowledges its obligation to reimburse the
FKAA for all prior legally incurred ex.penditures related to wastewater initiatives in the Key
Largo area and to pay in full to the FKAA all remaining reimbursements due within thirty (30)
days of the effective date of this resolution.
(C) Monroe County commits to obtain and convey to the FKAA in fee simple the
proposed wastewater treatment plant site approved by FEMA at Mile Marker 100.5 (the "Mile
Marker 100.5 Site"), Time is of the essence in acquiring the Mile Marker 100.5 Site and Monroe

negotiate the purchase for the site. It is recogniled that the cost (0 acquire the site is an eligible
expense from funding under the Unmer Needs Program and/or the required matching grant
dollars_
(D) Within fifteen (15) days after the effective date hereof, the FKAA shall propose
the area(s) that will be served by the Mile Marker 100.5 Site,] (sometimes commonly referred to
as a "hor spot") Monroe County shall be responsible for affinning and approving by resolution
lhe proposed area(s) to be served within thirty (30) days thereof.
(F) Monroe County shall work diligently with the FKAA to develop and adopt,
within sixty (60) days of the effective date hereof. a subsequent joint resolution which will
provide a series of milestones or critical events, acceptable to the FKAA and FEMA for the
completion of wastewater project(s) in the Key Largo area,
(G) Monroe County agrees to timely implement the foregoing critical events schedule
adopted by the FKAA and Monroe County as approved by FEMA
SECTION 3. FKAA COMMITMENTS TO MONROE COUNTY. In order to
secure wastewater project funding under the Unmet Needs Program for the Key Largo area, the
FKAA commits and agrees as follows:
(A) FKAA shall work diligently with Monroe County to develop and adopt. within
sixty (60) days of the effective date hereof. a subsequent joint resolution which will provide a
series of milestones or critical events, acceptable to Monroe County and FEMA. for the
completion of wastewater project(s) in the Key Largo area (using the Mile Marker 100.5 Site),
(B) FK.AA agrees to timely implement the critical events schedule adopted by the
FKAA and Monroe County as approved by FEMA; provided however, that all FKAA activities
called for under this resolution shall be paid as an eligible expense from funding under the
Unmet Needs Program and/or the required matching grant dollars. or otherwise reimbursed to
FKAA by Monroe County.
(C) Upon the creation. establishment and organization of the Key Largo Wastewater
Treatmenr District (the "District") by the Florida Legislature as an mdependent special purpose
local government, the FKAA agrees to conveyor otherwise transfer all wastewater facilities and
responsibilities to the District wjthout additional cost (other than full reimbursement as set forth
in subsection (B) above) upon the District's unqualified acceptance and assumption of all
liability and responsibility associated therewith. Any such transfer shall be first subject to
approval by FEMA and DCA.
SECTION 4. INTERLOCAL AGREEMENT.
(A) This Resolution constitutes a joint exercise of JX>wer, privilege or authority by and
between Monroe County and the FKAA and shall be deemed to be an "Interlocal Agreement"

within the meaning of the Florida Inter-local Cooperation Act of 1969 as amended. This
Resolmion shall be filed with the Clerk of the Circuit COUll of Monroe County.
(B) This Resolution shall remain effective until the Vnmet Needs Program grant
funding addressed by this resolution is expended for wastewaler projecl(s) in the Key Largo area~
or, such grant funds are withdrawn by FEMA or DCA and are no longer available, and until the
FKAA has been fully paid all sums as required hereby.
SECTION 5. SEVERABILTY. Any provision of this Resolution shall be held invalid
or unenforceable by any court of competenl jurisdiction, such holding shall not invalidate or
render unenforceable any other provisions thereof.

Pursuant to the joint resolution between Monroe County and the Aqueduct Authority regarding the proposed
provision of waste-water service to one or more community "hot spot" areas in Key Largo, the Aqueduct
Authority submits the following reconnnendations for the proposed area(s) to be served for consideration by
the Board of County Commissioners:
Prima" Recommendation: Key Largo Trailer Village (approximately 450 dwelling units)
Justifications: This area is ranked No.2 of 21 identified priority hot spot areas in the Upper Keys as
per the adopted Monroe County Sanitary Wastewater Master Plan.
It is the nearest high priorIty community hot spot in reasonable proximity to the
proposed treatment plant site at M.M. 1005.
Separate acquisition of additional property for a pump station is not reqUIred.
EXIsting non-residential development fronting the bay side of US. Highway One from
M.M. 100.5 to M.M. 101.5 will also be served (approxImately 30 equivalent dwelling
units)
Immediate supplemental additional project sub-areas available to be served:
(based on sufficient FEMA a..,dfor supplemental grant/match funding)
1. Hibiscus Park subdivision (approximately S5 dwelling units)
(Low mcomel1arge rninority population-recommend County apply for a
competitive CDBG gra..,t with matching SHIP funds)
2. Holiday Homesites subdivision (approx:.imately 60 equivalent
dwelling units) may be added to t.he project.

Our Primary Recommendation (per the County's Sanitary Wastewater Master Plan) of a proposed area to be
served is provided to the Board of County Commissioners for consideration and approval by Resolution at
the March BOCC mtGhu!j in accOTdance with the previously referenced joint resolution. Upon BOCC
approval, the Authority will initiate its obligations under the previously provided milestones and critical
events in coordination with the implementation of Monroe County's and FEMA's listed obligations.
In the event Monroe County chooses to consider the pro\.'lsion of wastewater scn.ice under the FEMA unmet
needs fundini program to one or more community hot spot areas other than the above listed
(primary/secondary) recommendations, may require increased local match commitments for planning and
engineering-

Resolution indicating the County's sel~etion of the conununity hot spot area(s) to receive wastewater service.

Law 106-31, Emergency Supplemental Appropriations Act for Fiscal Year 1999
(1249 and 1259 Unmct Needs Program)
Dear Mr. Roberts:
This Jetter is follow up to the ~arch 12, 2002 meeting held between our office, the Florida Keys
Aqueduct Authority, the Florida Division of Emergency Management, and your staff; concerning
the above referenced project. During the meeting, the project 'Milestones and Critical Events
List' drafted by the Aqueduct Authority was discussed. This docwnent proposes key steps and
pany responsibility towards project implementation. Although some of the key event dates are
to be determined. it is our understanding that the Board of County Commissioners plans to take
action at its March 20, 2002 meeting on proposing a Key Largo wastewater treatment service
area and alternatives. Once the Commissioners pass a Resolution proposing the service area (and
alternates), the County may further proceed with efforts to retain the treatment facility site at
Mile Marker 100.5 on Key Largo.
George Garrett and Jim Hcndnck indicated the Monroe County Land Authority was preparing a
purchase or option-to-buy proposal for the Mile Marker 100.5 parcel. This proposal would be
presented to the Board of County Commissioners at their regularly scheduled April meeting for
their approval. While FEMA cannot approve funding for parcel acquisition prior to completion
of environmental review, which is in progress, under the National Envirorunenlal Policy Act; this
expense is an eligible project cost that could be reimbursed to the Aqueduct Authority at a later
date. This should not preclude the County from initially committing to the parcel at its own
expense. Such effort would represent a substantive step towards project implementation and be
consistent with the Board's February 14 Joint Resolution relating to the above project.
