A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY I FLORIDA OPPOSING THE IMMIGRATION AND
NATURALIZATION SERVICE'S (INS) CONSTRUCTION OF A REFUGEE
HOLDING FACILITY IN THE CITY OF LAYTON
WHEREAS, the INS proposes to construct a refugee holding facility in the City of Layton;
WHEREAS, such a facility would increase vessel and vehicle traffic in Layton and otherwise
adversely affect the quality of life and residential property values within Layton; and
WHEREAS, the citizens of Layton are equally citizens of Monroe County; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. The INS is urged not to locate its refugee holding facility at the proposed
location in the City of Layton to the detriment of the residents of that City.
Section 2. The Clerk is directed to send a certified copy of this Resolution to the
County's Congressional delegation and to US Department of Justice, Immigration and
Naturalization Service, 70 Kimball Avenue, South Burlington, VT 05403, Attn. Lisa J. Mah~y.

Dear Senator Graham:
We regret the delay in responding to your letter of May 22, 2002 with enclosures from
Ms. Pamela G. Hancock concerning the Immigration and Naturalization Service(INS)proposal
to establish a Border Patrol facility to process and briefly hold illegal migrants.
The primary mission of the Border Patrol(BP)is to secure our Nation's borders against
illegal migration, narcotics smuggling, and the entry of aliens,with.criminatintent, •Of•course,
the tragic events of September 11,.2001 ,have placed.increased emphasiwbordersecurity and
homeland'defenge. As the'current allocation'of.resources,limits the ability:of the INS BP to' .
monitor and control Our ocean'border in South Florida, we have sought to.establish a new BP
office with short-term holding cells in Layton to support our mission.
In 1999, the BP began its effort to establish this office and processing facility in Layton.
Since then, we have held numerous meetings to solicit input, and to identify and address
community concerns. The INS selected the location of this interim facility in accordance with
the National Environmental Protection Act of 1969. This process ultimately determined that the
proposal was not likely to have any significant adverse environmental impact and resulted in a
Finding of No Significant Impact.
The INS Chief Patrol Agent,Lynn Underdown, will continue to work with the residents
of Layton in an effort to understand fully the local activity affecting this new facility, and to
ensure the INS's ability to address issues of mutual concern.
For clarification, please understand that the INS does not intend to establish a "detention
center" within the city of Layton. Rather, the BP plans to establish an office to accommodate the
agents responsible for patrolling the water boundaries in that area of operation. Holding cells to
maintain migrants'for short periods,.for example 3-4 hours, are envisioned as part of this facility
to ensure the safety and welfare of those being processed. However, the primary function.of.this
facility will be to serve as office space for the agents assigned.there...Once processing is •
complete,.aliens will be moved directly to the INS Krome Detention.

As in the past,the INS would like to assure you that we are committed to working with
you, your staff, and concerned residents of the Layton community. After actively considering
alternative locations,we firmly believe that a Layton facility would best serve the interests of the
INS/Border Patrol as we work to secure our Nation's borders.
