AGENDA ITEM WORDING: Discussion of constructing wastewater "facilities" on private property
and private roads within easements granted by the owner.
ITEM BACKGROUND: FKAA has historically followed its policy of installing "facilities" for
existing multi -unit residential properties and private roads serving at least five customers if it is
determined to be in the best interest of the FKAA and customer. The "facilities" remained under the
ownership of FKAA and are constructed in utility easements that are dedicated to the FKAA by the
owner. The Conch Key and Little Venice projects included construction of "facilities" on private
property. Implementation of the Stock Island project by KWRU did not include provision of
"facilities" on private roads or property. It was determined that the installation of "facilities" on a
private road in Layton was not in the best interest of the FKAA and the customer. It is the policy of the
Key Largo Water Treatment District and Marathon to provide service to the property line. The
Islamorada Village Council voted to extend "facilities" onto private property within the Phase I and
Phase 2 boundaries of the Plantation Key project.

Property
(1) As part of the construction of new wastewater systems, the Authority will, in
certain cases and only through an Agreement with the property owner, construct
wastewater collection and transmission systems and water distribution systems on private'
property when it is determined to be in the best interest of the Authority and the users of.
the new system. This policy applies only to the construction of wastewater systems in;
areas receiving wastewater service from the Authority for the first time (as specified
under herein).
(2) This policy is applicable only to privately -owned multi -family residential
properties that meet the criteria below:
(a) The property must have a minimum of five (5) dwelling units, as defined in
Chapter 48-101.002 (51) of the Authority's Rules and Regulations.
(b) The property must have sufficient ingress and egress for construction equipment.,;
The decision as to whether the property meets this criteria is solely within the discretion
of the Authority.
(c) The property must meet the definition for residential service. For mixed use
properties that include both commercial and residential service, the residential service:
portion of the property must be at least 50% or more of the total EDUs served, as
determined by the Authority based on Property Appraiser records, other State and local
laws and regulations, and either available information, to be considered as residential use
(3) To qualify under this policy, the property owner must agree to the following
conditions:
(a) The units within the property must be individually metered for potable water,
service and the corresponding wastewater charges for monthly service must also be based
on individual meters.
(b) The property owner must grant all necessary easements and rights -of -way as
necessary to allow for the installation of the potable water lines and wastewater collection
system (the FKAA Facilities).
(c) The property owner must execute an Agreement with the Authority authorizing
the construction of water distribution systems and wastewater collection systems within
the easements granted.
(d) If the property owner elects not to enter into Agreement with the Authority for
water distribution systems and/or wastewater collection systems, then the property owner
will be required to comply with Mandatory Connection to Wastewater System (Section
48-301-006).
(e) The properly owner will be responsible for the cost of constructing the
connection from the dwelling units and/or structures to the FKAA Facilities (i.e.,
construct the water service lines to the metering point and the wastewater lateral to the
stub -out, vacuum pit, or other point of connection to the FKAA Facilities) and the cost of
abandoning on -site wastewater systems, including cesspits.
(f) If there is an existing water distribution or wastewater collection system on the
property, and the systems comply with FKAA. specifications, the owner shall convey the

1 systems, at no cost, to the Authority. It will be the responsibility of the property owner to
2 decommission or otherwise dispose of an existing wastewater treatment facility. The
3 Authority may utilize the existing systems or replace them, solely at the discretion of thy;
4 Authority.

6 (4) As a result of this policy, the Authority will perform the following:
7 (a) The Authority may install a water distribution system, service lines and individual
8 meters within the easement, excluding lateral service lines from the easement to the
9 dwelling unit as a condition of providing service. If the properly is already served by a
10 potable water distribution system owned by the Authority, the Authority may elect not to.
I I install a new system if the existing system is considered to be usable and not required to
12 be relocated due to the installation of the wastewater collection system. If the existing
13 water distribution system is conveyed to the Authority, the Authority shall operate and.
14 maintain the system or replace it at no cost to the owner.
15 (b) The Authority agrees to install a wastewater collection system within the property
16 as a condition of providing service. If the existing wastewater system is conveyed to the
17 Authority, the Authority shall operate and maintain the system or replace it at no cost to
18 the owner.
19 (c) After construction of the FKAA Facilities, the FKAA will own, operate and
20 maintain the FKAA Facilities and have the right to enter the property to ensure the
21 continuance of service.
