AMf�iDM iT FROM RECREATIONAL VEHICLE TO URBAN ►�- �R.ESIDENtIAL MOBILE HOME LIMITED ON PROPERTY KNOWN AS SEASIDE RESORT AND LOCATED ON BIG COPPITT KEY, FLORIDA MM 11; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE - DATE c� a o co CC o o �? 4 tE S ,'7" !Se 9.5-511(c), Monroe County Code of 0 ordin cep pk&ViRles that the regulations, including the land U- N `. v use di,trt fps � may be amended or changed at any time; and v WHERPR�S, o du-9ing such process, the Monroe County Planning Commission, sitting as the local planning agency, after due notice and public participation in the hearing process, reviewed the proposed land use district map change and found such change consistent with the Monroe County Comprehensive plan and made a recommendation concerning such change to the Monroe County Board of Commissioners; and WHEREAS, during such process, the Monroe County Board of Commissioners, after due notice and public participation in the hearing process, reviewed such recommendation and legislatively acted thereon; and WHEREAS, F.S. 380.0552(9) requires that the state land planning agency approve all proposed land use district map changes before such changes may become effective; and WHEREAS, the land use district map change process is not complete; and WHEREAS, it is desired that the Monroe County Board of Commissioners should approve, adopt and transmit this land use district map change to the state land planning agency for approval; now, therefore, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. The Monroe County Board of Commissioners on this 13, day of November, 19900. does hereby adopt this land use district map amendment, pursuant to general law, and attached and incorporated by reference to this ordinance, and hereby transmits to the state land planning for approval or disapproval pursuant to F.S.380.0552(9) Section 2. If any section, subsection, sentence, clause, item, change, or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. This ordinance shall be filed in the Office of the Secretary of State of the State of Florida but shall not be deemed effective until approved by the state land planning agency. Section 9.5-511 (5) ACTIONS BY BOARD OF COUNTY COMMISSIONERS FOLLOWING PUBLIC HEARING(s): Findings based on factors i through vi regarding changes to the land use district map i. A change of land use district from Recreational Vehicle (RV) to Urban Residential Mobile Home Limited (URM-L) will not change projections with regard to public service needs. On the con- trary, a permanent residential district designation instead of a temporary, road ready district designation, may be considered as a lessening of impact of potential increased Levels of Service on U.S. No.l, if the park were to be mobilized to conform to it's current RV district designation ii. There are no changed assumptions. A change to URM-L will not affect the existing density. This is an existing built out condominiumized park, and original assumptions relative to future growth projections were based on this park as a condominium dis- trict recreational vehicle park and was considered a permanent residential district iii. The data error would be in mapping. This existing condominiumized park is not consistent with the Recreational Vehicle designation, and not in keeping with the community charac- ter as described in Volume I. Under the old code this park was zoned RU-8 - Condominium District Recreational Vehicle Park. The RV designation has rendered this park non -conforming. iv. New issues are that owners of existing, permanent and tied down -Recreational Vehicles cannot construct conventional addi- tions and cannot replace the structure below base flood elevation unless the district is changed to reflect permanency instead of transiency, and the intrusion of Single Family Residences is prohibited V. The recognition of a need for additional detail or compre- hensiveness is necessary in order to distinguish between 100% pure mobile home parks with the ability to replace the mobile home below the base flood elevation and other districts in which both single family residences and mobile homes are allowed but must meet or exceed the base flood elevation vi. Data concerning mobile home parks has been updated by the by the extensive study undertaken by the Monroe County Growth Management Division dated July 1988. vii. A change in land use designation from Recreational Vehicle to Urban Residential Mobile Home will not result in adverse commu- nity change within the planning area. i14-AP CHANGE REQUEST 547 STAFF REPORT REQUEST: Change from: RV to URM-L APPLICANT: Monroe County Planning Department PROPERTY LOCATION: KEY: Big Coppitt MILE MARKER: 11 COUNTY MAP NUMBER(S): 547/538 Flood Elevation: AE 10' and VE 10' Panel 1732 Average Grade: approximately 2 to 3' above MSL SITE DESCRIPTION: Subdivision: Seaside Resort, Inc. Site: Approximately 202 lots General lot size: 60 to 70X30 LAND CONDITIONS: 81% existing development predominant land use: Recreational Vehicles - Non Road Ready and tied down in accordance with Section 6-16 of the Monroe County Code. Most have existing conventional additions, such as Florida Rooms and screened porches. There are some vacant lots, privately owned which are used on a seasonal basis. IMPROVEMENTS: approximate: # of lots vacant: 40 (19%) # of lots Mobile Homes Not Elevated: 20 # of lots Mobile Homes Not Elevated W/ Conventional Addition 38 # of lots Mobile Homes Elevated: 0 # of lots Recreational Vehicles 43 # of lots Recreational Vehicle W/ Conventional Addition 61 No single family residences, no elevated structures. 100% pure manu- factured home park. CHARACTER OF STRUCTURES: Recreational Vehicle and Mobile Homes predominately with conventional additions. SUMMARY: This area is 100 % pure manufactured home, with less than 40 vacant lots. The trend in this park is to remain RV and Mobile Home. There has been no intrusion of -Single Family Residences, and there is no indication of future intrusion. The indication is that the exist- ing vacant lots used on a seasonal basis now, will eventually be per- manent park model homes for the owners.
