3. Task Order 2 - Review Services 02/17/2021 TASK ORDER TWO FOR ENVIRONMENTAL& HISTORICAL REVIEW SERVICES BETWEEN MONROE COUNTY AND TETRA TECH, INC. FOR THE VOLUNTARY HOME BUYOUT PROGRAM FOR TASKS AND DELIVERABLES ASSOCIATED WITH THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY SUB-RECIPIENT AGREEMENT 10092 In accordance with the contract for Environmental & Historical Review Services made and entered on the 17th day of November, 2020, by and between Monroe County hereinafter referred to as the "County" and Tetra Tech, Inc. hereinafter referred to as "Consultant" for the Voluntary Home Buyout Program. All terms and conditions of the referenced Contract for Environmental & Historical Review Services shall apply to this Task Order, unless the Task Order modifies an Article of the Contract which will be specifically referenced in this Task Order and the amendment, addition or modification shall be precisely described. This Task Order is effective on the 17th day of February 2021. 1. In accordance with the Environmental & Historical Review Services contract, attachment A, Scope of Work and Pricing, the Consultant will perform services as described below: a) The environmental review services: • Assess each VHBP project site to verify the level of environment review required. • Conduct site visit to project location and completion of a field observation report. • Complete and submit the environmental review to DEO. • Prepare, complete and submit HUD required forms for environmental review and provide all documentation to support environmental findings • Consult and coordinate with oversight/regulatory agencies to facilitate environmental clearance • Perform special studies, additional assessments, or permitting to secure environmental clearance. These may include, but are not limited to biological assessments, wetland delineations, asbestos surveys, lead- based paint assessments, archeology studies, architectural review, Phase I and II ESAs, USACE permits. • Complete a Categorical Exclusion, an Environmental Assessment, a FONSI, a Phase I and/or a Phase II or tiered assessment as needed. • Prepare responses to comments received during comment phase of the environmental review, including State/Federal Agency requiring further studies and/or comments from public or private entities during the public comment period • Coordinate with local officials, project engineer and other members of the project team to assure appropriate level of environmental review is performed and no work is conducted without authorization. • Prepare public notices including, but not limited to the Notice of Finding of Environmental& Historical Review Services Task Order Two For the Monroe County Voluntary Home Buyout Program Page 1 of 4 No Significant Impact (FONSI), Request for Release of Funds flood plain/wetland early and final notices in required order and sequence • Provide documentation of clearance for Parties Known to be Interested as required by 24 CFR 58.43 • Process environmental review and clearance in accordance with NEPA • Advise and complete environmental re-evaluations per 24 CFR 58.47 when evidence of further clearance or assessment is required b) The historic review services • Complete historical preservation reviews under Sec. 106 of the National Historic Preservation Act of 1966 (54 U.S.C. Section 306108) following the required Professional Qualification Standards as set forth in 36 CFR Part 61. • Perform site visits and conduct all necessary required inspections. • Evaluate and submit report of findings for the Historical Review • Prepare all necessary compliance reports and forms for quality control. • Participate in meetings and/or conference calls to discuss project(s) and the Historical Review and propose/coordinate strategies for resolving issues. • Expedite procedures required by the Department of Housing and Urban Development (HUD) for specific Community Development Block Grant for Disaster Recovery programs. • Gather all necessary data to conduct an historic review in compliance with federal, state, and local rules, regulations and requirements including online research, site visits, historic preservation office data • Delineate area of potential impacts, identify affected parties, provide recommendation for treatment and mitigation • Collect and enter historical review data into project data management system • Review the documents for completeness and evaluate the level of review which may be required for each project • Prepare maps for use in consultation and site inspection • Coordinate with all internal and external stakeholders as required • Conduct archaeological studies and architectural surveys if required • Inspect the site and immediate vicinity to collect needed information not accessible in a desktop review 2. The tasks above shall be performed in accordance with Attachment A of the Environmental & Historical Review Services Contract. The costs for Consultant's services set forth in this Task Order shall not exceed $139,685.70 for Services related to implementation of the Voluntary Home Buyout Program based upon the pricing as set forth in Attachment A— Scope of Work and Pricing in the contract dated November 17, 2020.The above scope of work is based on an estimated 21-month period of performance from February 17, 2021 through November 17, 2022. Timelines in the delivery schedule may be extended by mutual agreement between the County and Tetra Tech. The fee for services will be based on the actual hours of services furnished multiplied by Consultant's hourly rates. *Consultant may take the following actions, in its discretion, so long as the Consultant does not exceed the estimated total: (i) Use fewer hours of one labor category and more hours of another labor category or categories and (ii) use fewer hours within one project task and more hours within another project task. *The hourly rates are fully burdened to include overhead, profit, travel expenses, program printing, and mailing cost. 3. Task Order One Assumptions areas follows: a) Project Sponsor: County will assign a primary point of contact to serve as project sponsor to address administrative and functional issues. b) Work Location: Project management and environmental support services performed under this task order will for the most part be performed remotely c) Program Allocation: Tetra Tech understands that $15,000,000 in CDBG-DR funds will be utilized for this buyout program. Should the Florida Department of Economic Opportunity (FDEO) reassign additional funds, we will work with the County to develop a supplemental scope of work and budget for the additional level of effort. d) Data Management: Tetra Tech will utilize Monroe County's VHBP system of record. Access to, protocols for use and any required trainings will be provided by the County related to use in supporting the environmental review documentation requirements. e) Key Personnel: Availability of County key personnel is critical to obtaining the information required for the overall success of this project. Information presented by key personnel will be accepted as factual and no confirmation will be made. f) Project Schedule: Tetra Tech will work with the County to continue to refine the project schedule to monitor project progress and make mutually agreed upon adjustments as needed. If Tetra Tech's project schedule is delayed or the effort of Environmental& Historical Review Services Task Order Two For the Monroe County Voluntary Home Buyout Program Page 3 of 4 work is increased due to circumstances outside of Tetra Tech's control, such as delays in the tasks performed by County procured contractors or County departments,Tetra Tech will notify the County if Tetra Tech's level of effort needs to be increased. g) Duration of Work: The estimated project term is 21 months. The period of performance may be extended upon approval by both parties. To the extent the term is required to be extended due to reasons beyond the Tetra Tech Team's control; such unforeseen circumstances may result in an increase in the project timeline and/or budget. h) Additional Services: If additional services are requested, Tetra Tech will respond with a fee proposal to perform the requested services. i) Estimated Budget: The budget for Environmental & Historical Review services in this contract are considered estimates and Tetra Tech reserves the right to adjust the budget,with Countyapproval,during the course of program execution if scope parameters change. 4. This Task Order One shall be effective as of February 17, 2021 and shall remain in effect until such services are no longer required or in accordance with section 9.5 of the contract. 5. All other Terms and Conditions of the Task Order shall remain in accordance with the Contract dated November 17, 2020.
