Ordinance 010-1993 Contractor' s Examining Board ORDINANCE NO. 010 -1993 AN ORDINANCE AMENDING SECTIONS 6-83, 6-84, AND 6-85 , PROVIDING FOR THE APPOINTMENT OF AN ALTERNATE EXAMINING BOARD MEMBER TO SERVE AT ANY REGULARLY SCHEDULED MEETING OF THE CONTRACTOR' S EXAMINING BOARD WHEN A QUORUM CANNOT BE REACHED BY THE ATTENDANCE OF THREE OR MORE REGULAR MEMBERS ; PROVIDING FOR THE METHOD OF APPOINTMENT; AND PROVIDING FOR INCLUSION IN THE LIMITATIONS ON TERMS OF OFFICE, REMOVAL AND VACANCIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1 . Sec. 6-83 , Monroe County Code shall be amended to read as follows : The following examining board is hereby created: o co - (1) One (1) person holding an o F engineering I card. o z rn (2) One (1) person holding a c) i--6 contractors I card. o • r- c= (3) One (1) person holding a master 2 7 plumber' s card. c) -0 73 (4) One (1) person holding .a master '-,, .".; = 3 g electrician' s card. o . (5) One (1) person holding a master 2 r" ro o mechanical card. t' CO (6) One (1) person, holding any of the foregoing qualifications and having previous- ly served as a regular member of the contrac- tor' s examining board shall be a designated alternate to serve at any regularly scheduled meeting of the contractor' s examining board only upon the inability of a quorum to be met in the absence of said alternate. Section 2 . Sec. 6-84(a) , Monroe County Code shall be amended to read as follows : (a)• The examining board shall consist of five (5) regular voting members and one alternate voting member appointed by the board of county commissioners . The building official or his designated agent shall serve as secretary to the board and shall have no vote. Legal counsel shall be furnished by the county attorney, or his designated representative. The members of the board shall be proportionately representative, of the trade or trades related to the subject matter concerned in the examination and qualifications, and professions within and connected with the particular trades con- cerned shall be represented. The five (5) regular member composition shall, at all times, include at least one (1) representa- tive from each of the Lower, Middle and Upper Keys of Monroe County. No member of the examining board shall receive any compensation for duties involved. Section 3 . Sec . 6-84(b) Monroe County Code shall be amended to read as follows : (b) No officer, director or administrator of Florida state, county or regional professional or occupational 'organization or association, while holding such position shall be eligible to serve as a member of the examining board for the profession or occupation. Each regular member shall have five (5) years of active participation in his respective field and shall be currently involved as a licensed contractor in that field to qualify for appointment. The alternate member shall be a prior member of the contractor' s examining board and shall be currently involved as a licensed contractor. Section 4. Sec. 6-85(a) Monroe County Code shall be amended to read as follows : (a) Each member, regular or alternate, shall be selected for a period of three (3) years and shall be permitted to serve no more than two (2) consecutive terms . Section 5 . Sec. 6-85 (b) Monroe County Code shall be amended to read as follows : Elf (b) Any member, regular or alternate, of the examining board may be removed from office by a majority vote of the complete board of county commissioners . Section 6. Sec. 6-85(c) Monroe County Code shall be amended to read as follows : (c) Any vacancy occurring during the unexpired term of office of any member, regular or alternate, of the examining board shall be filled by the board of county commissioners for the unexpired term thirty (30) days after such vacancy occurs. Section 7. Sec. 6-85(d) Monroe County Code shall be amended to read as follows : (d) Any regular member of the contrac- tor' s examining board who absents himself from any three (3) consecutive regular meetings of the contractor' s examining board, unless excused from such attendance by consent of the board, expressed by action of record in its official minutes , or who is absent from a total of four (4) regular meetings of the board in any fiscal year without having been excused from such atten- dance by consent of the board expressed by action of record in its official minutes shall thereby automatically forfeit his position and office as a member of the contractor' s examining board; and the name of such person shall be automatically removed from the membership of the board immediately after the adjournment of any such third consecutive meeting or any such fourth meeting in any fiscal year, as the case may be, at which such member has not appeared. The board shall thereupon promptly notify the member so removed, and the board of county commissioners for Monroe County shall there- upon appoint a new member to serve the remainder of the unexpired term for the member so removed. Section 8. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. `i Section 9 . All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 10. The provisions of this Ordinance shall be included and incorporated in the Code . of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 11 . This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
