Ordinance 033-1986 Monroe County Commission ORDINANCE NO. 033 -1986 AN ORDINANCE OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, CONFIRMING THE ADOPTION OF THE MONROE COUNTY COMPREHENS IVE PLAN AND LAND DEVELOPMENT REGULATIONS ON FEBRUARY 28, 1986; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners adopted a Comprehensive Plan and Land Development Regulations on February 28, 1986, pursuant to Florida Statutes, Chapter 125; and WHEREAS, the Board of County Commissioners transmitted for approval said Plan and Land Development Regulations to the Department of Community Affairs pursuant to Florida Statutes, Chapter 380; and WHEREAS, the Board of County Commissioners held public hearings after 5:00 p.m. on January 16, 1986, January 23, 1986 and February 28, 1986, with notice given in accordance with the requirements of Florida Statutes, Section 163.3161, et seq., and Florida Statutes, Chapter 125.66; and WHEREAS, the Administration Commission approved said Plan and Land Development Regulations by Rule on July 28, 1986; and WHEREAS, the effective date of said Rule and, therefore, the Plan and Land Development Regulations, is September 15, 1986; and WHEREAS, new provisions of the Florida Statutes (the Growth Management Act of 1985, as amended in 1986) may create some confusion regarding the dates of adoption and effective date of the Plan and Land Development Regulations; now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. The date of adoption of the Land Use Plan and Land Development Regulations on February 28, 1986 is hereby confirmed by ordinance. Section 2. The effective date of the Land Use Plan and Land Development Regulations is September 15, 1986. Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of any such conflict. Section 5. , This ordinance shall take effect immediately upon receipt of official notice from the office of the Secretary of State of the State of Florida that this ordinance has been filed with said office.
